En sixième et dernier lieu, le Tribunal de la fonction publique a pris acte du refus de la Commission de lui fournir les éléments d’information qu’il avait demandés dans le cadre des mesures d’organisation de la procédure et, considérant que les raisons invoquées par la Commission pour justifier ce refus n’étaient pas convaincantes, est parvenu à la conclusion que la décision du 19 juin 2007 devait être annulée, motif pris de la violation de l’obligation de motivation (points 53 à 55 de l’arrêt attaqué).
Sixth and finally, the Civil Service Tribunal took note of the failure on the part of the Commission to produce the items of information requested by it by way of measures of organisation of procedure and, considering that the reasons put forward by the Commission to justify that failure were unconvincing, concluded that the decision of 19 June 2007 had to be annulled on the ground that there had been a breach of the obligation to state reasons (paragraphs 53 to 55 of the judgment under appeal).
