Le succès d'un certain nombre de partenariats public/privé, encouragés par le principe pari passu, a suscité des investissements récurrents de la part des investisseurs privés, venant compléter l'intervention des autorités publiques. Il a également rendu plus facile le recrutement, dans le secteur privé, de gestionnaires indépendants et expérimentés qui se voient offrir une rémunération liée au retour sur investissement et/ou à la performance du fonds d'investissement concerné.
The success of a number of public/private partnerships encouraged by the pari passu principle has generated recurring investment by private investors, along with public authorities, and has made it easier to recruit experienced independent managers from the private sector, receiving a remuneration linked to the return on investment and/or the performance of the investment fund.

Recognises that state aid rules exist to provide legal certainty for state intervention where there is particular market failure; calls on the Commission and the Member States to make full use, for the purposes of increased energy security and the transition to a low-carbon and resource-efficient economy, of the possibilities allowed for financing energy projects through state aid, as well as the financial instruments available through the European Regional Development Fund, the Cohesion Fund, the European Fund for Strategic Investment, the Connecting Europe Facility, Horizon 2020, the European Neighbourhood Policy Instrument, and the investment facilities of the European Investment Bank and the European Bank for Reconstruction and Development, as well as public and private intermediaries, and calls on the Commission to conduct a regular cost-effectiveness assessment of the EU’s financial instruments; calls on the Commission and the European Investment Bank to urgently define new instruments and financial products adapted to the specifics of long-term investments in low-carbon energy technologies; welcomes the fact that the Investment Plan counts energy as one of its priorities; considers that the Commission should clarify how it intends to use the EUR 315 billion Investment Plan, mixed with the other existing funds;

(17a) EIOPA’s and relevant NCAs’ powers should be complemented with an explicit mechanism for prohibiting or restricting the marketing, distribution and sale of insurance-based investment products giving rise to serious concerns regarding investor protection, orderly functioning and integrity of financial markets, or the stability of the whole or part of the financial system, together with appropriate coordination and contingency powers for EIOPA. This is to reflect also the powers provided to ESMA and EBA under MiFIR, so as to ensure such mechanisms for intervention can be applied for all investment products irrespective of their legal form.

Afin de garantir la cohérence entre ces dispositions, qui doivent entrer en vigueur simultanément, et pour en donner une vision globale et un accès rapide à tous les résidents de l'Union, il est souhaitable d'inclure les dispositions sur les catégories d'intervention au titre de l’objectif «Coopération territoriale européenne» dans le présent acte d'exécution dans la mesure où la procédure concernant la consultation du comité de coordination des Fonds structurels et d'investissement européens, établi par l'article 150, paragraphe 1, du règlement (UE) no 1303/2013, est identique à celle prévue pour les autres dispositions relevant du présent acte d'exécution, alors que les catégories d'intervention au titre de l’objectif «Investissement pour la croissance et l’emploi» font l'objet d'une procédure différente.
To ensure coherence between those provisions, which should enter into force at the same time, and to facilitate a comprehensive view and compact access to them by all Union residents, it is desirable to include provisions on categories of intervention for the European territorial cooperation goal into this implementing act as the procedure with regard to the consultation of the Coordination Committee for the European Structural and Investment Funds established by Article 150(1) of Regulation (EU) No 1303/2013 is the same as for the other provisions covered by this implementing act, whereas categories of intervention for the Investment for growth and jobs goal are subject to a different procedure.
