4. When the range of financial instruments assessed by the investment firm providing investment advice on an independent basis includes the investment firm's own financial instruments or those issued or provided by entities having close links or any other close legal or economic relationship with the investment firm as well as other issuers or providers which are not linked or related, the investment firm shall distinguish, for each type of financial instrument, the range of the financial instruments issued or provided by entities not having any links with the investment firm.

11. When providing investment advice or portfolio management services that involve switching investments, either by selling an instrument and buying another or by exercising a right to make a change in regard to an existing instrument, investment firms shall collect the necessary information on the client's existing investments and the recommended new investments and shall undertake an analysis of the costs and benefits of the switch, such that they are reasonably able to demonstrate that the benefits of switching are greater than the costs.

Investment firms shall provide a description of the types of financial instruments considered, the range of financial instruments and providers analysed per each type of instrument according to the scope of the service, and, when providing independent advice, how the service provided satisfies the conditions for the provision of investment advice on an independent basis and the factors taken into consideration in the selection process used by the investment firm to recommend financial instruments, such as risks, costs and complexity of the financial instruments.

Directive 2014/65/EU establishes the framework for a regulatory regime for financial markets in the Union, governing operating conditions relating to the performance by investment firms of investment services and, where appropriate, ancillary services and investment activities; organisational requirements for investment firms performing such services and activities, for regulated markets and data reporting services providers; reporting requirements in respect of transactions in financial instruments; position limits and position management controls in commodity derivatives; transparency requirements in respect of transactions in financial instruments.

83. Recognises that state aid rules exist to provide legal certainty for state intervention where there is particular market failure; calls on the Commission and the Member States to make full use, for the purposes of increased energy security and the transition to a low-carbon and resource-efficient economy, of the possibilities allowed for financing energy projects through state aid, as well as the financial instruments available through the European Regional Development Fund, the Cohesion Fund, the European Fund for Strategic Investment, the Connecting Europe Facility, Horizon 2020, the European Neighbourhood Policy Instrument, and the investment facilities of the European Investment Bank and the European Bank for Reconstruction and Development, as well as public and private intermediaries, and calls on the Commission to conduct a regular cost-effectiveness assessment of the EU’s financial instruments; calls on the Commission and the European Investment Bank to urgently define new instruments and financial products adapted to the specifics of long-term investments in low-carbon energy technologies; welcomes the fact that the Investment Plan counts energy as one of its priorities; considers that the Commission should clarify how it intends to use the EUR 315 billion Investment Plan, mixed with the other existing funds;

Member States shall require that where an investment firm informs the client that investment advice or discretionary portfolio management is given on an independent basis, the investment firm assesses a sufficiently large number of investment products or financial instruments available on the market which are sufficiently diversified with regard to their type and issuers or product providers to ensure that the client's investment objectives can be suitably met and is not limited to financial instruments issued or provided by entities having close links with the investment firm.

Considers that the EU and the Member States should take action notably to enhance the use of the Structural Funds and the Cohesion Fund as a catalyst for attracting additional funding from the EIB, EBRD, other international financial institutions and the private sector, while encouraging initiatives based on public-private partnerships (PPP), such as EU Project Bonds; notes that SMEs can particularly benefit from investments that strengthen capacities, infrastructure and human capital; recognises the potential of extending the scope of innovative financial instruments so that they are used to greater effect as access to finance to complement traditional financing methods; stresses that the revolving nature of financial instruments and a flexible approach to integrating such instruments at regional level could achieve a multiplying effect of the EU budget, foster public-private partnerships, open up alternative sources of finance and provide an important new financing stream for strategic investments, supporting long-term, sustainable investments at a time of fiscal constraint;

To align incentives further, a substantial portion of variable remuneration of all staff members covered by those requirements should consist of shares, share-linked instruments of the credit institution or investment firm, subject to the legal structure of the credit institution or investment firm concerned or, in the case of a non-listed credit institution or investment firm, other equivalent non-cash instruments and, where appropriate, other long-dated financial instruments that adequately reflect the credit quality of the credit institution or investment firm.
