Calls on the Commission to conduct, before the end of 2014, an in-depth assessment of the existing Mutual Legal Assistance Agreement, pursuant to its Article 17, in order to verify its practical implementation and, in particular, whether the US has made effective use of it for obtaining information or evidence in the EU and whether the Agreement has been circumvented to acquire the information directly in the EU, and to assess the impact on the fundamental rights of individuals; such an assessment should not only refer to US official statements as a sufficient basis for the analysis but also be based on specific EU evaluations; this in-depth review should also address the consequences of the application of the Union’s constitutional architecture to this instrument in order to bring it into line with Union law, taking account in particular of Protocol 36 and Article 10 thereof and Declaration 50 concerning this protocol; calls on the Council and Commission also to assess bilateral agreements between Member States and the US so as to ensure that they are consistent with the agreements that the EU follows or decides to follow with the US;

Supports stepping up the use of environmental impact assessments (EIAs), sustainability impact assessments (SIAs), strategic environmental assessments (SEAs) and other instruments in order to take account of biodiversity loss and the effects of climate change in regional and local decision-making; points out that all regions will benefit from projects that promote climate change mitigation and the protection of biodiversity loss, including less developed regions;

34. se félicite de l'accord sur l'utilisation des fonds non engagés du programme européen pour la relance (projets en matière d'énergie) en vue de créer un instrument financier spécialisé pour soutenir des initiatives énergétiques durables aux niveaux local et régional; demande un contrôle strict de cet instrument afin d'évaluer si ce type de financement pourrait servir de modèle aux futurs instruments visant à financer des investissements durables et à faible intensité de carbone;
34. Welcomes the agreement on using uncommitted funds from the European Recovery Programme (energy projects) to establish a dedicated financial instrument to support sustainable energy initiatives at local and regional level; calls for close monitoring of this instrument in order to assess whether this kind of funding could serve as a model for future instruments to finance sustainable and low-carbon investments;

Calls on the Commission to simplify the bureaucracy for the FP7 and CIP in order to strengthen the effects of synergies with the Structural Funds and to ensure regional-level analysis of research and innovation potential and needs as well as analysis of the inter-relations with other instruments in the evaluation studies on either of the three financing instruments in order to be able to provide joint guidance;

In the area of expenditure, the Council stresses the need, in particular: - to improve the management and control of the CMO in fruit and vegetables, and requests an assessment of the intervention system in this CMO once the reform has been fully applied; - for the Structural Funds, to reduce the concentration of payments at the end of the budgetary year by improving coordination between the Commission and the Member States; - in the field of regional policy, to take every step to ensure that the proper procedure is followed in respect of public works contracts, and to apply stringently environmental legislation in all action financed from the Community budget; - regarding policy on SMEs, to use a more precise and realistic definition of SMEs and to facilitate their access to the existing instruments; - in the area of research (Human Capital and Mobility programme), to ensure comprehensive, consistent management of the programme, and optimum coordination of the departments concerned; - regarding the PHARE and TACIS programmes, to improve coordination between those taking part, in order to ensure that the studies carried out are followed by specific action, and to conduct a systematic prior assessment before any decision is taken to renew each programme; - with respect to the programmes concerning the Mediterranean countries, to improve the allocation of its human resources, in order to optimize the conditions for implementing its programmes; - regarding the Commission's external delegations, to ensure strict compliance with Community rules on statutory and financial matters, and the establishment of an inventory of all movable property.

In order to achieve these objectives and insofar as they cannot be better achieved by the Member States, the Commission, assisted by a Committee composed of representatives of the Member States, will implement such measures as need be taken at Community level, allowing for the findings of any evaluation reports.
