In this respect, the applicant argues that if the Commission, before 8 August 2008 (the date on which the applicant approved an amendment to the restructuring plan concerning the preservation of the silos), had answered the applicant’s written question about the preservation of certain structures, if it had amended and supplemented Regulation No 968/2006 (1) and if, having received the communication relating to the alteration of the restructuring programme, it had informed the applicant of the alleged irregularity concerning the preservation of the silos, or if it had written to all the Member States informing them of its interpretation of the unclear provisions of the relevant legislation, the financial correction at issue would not have been made and the contested decision would not have been adopted.

In the present case, although it is clear from the pleas and forms of order set out above that the applicant is the unsuccessful party and that the Commission has applied for her to be ordered to bear the costs, it is also apparent that although the applicant had asked on several occasions for information about her, concerning her written tests (b) and (c), following the procedure laid down in Section D.4 of the notice of competition, and had received several communications from EPSO stating that the documents requested were attached to them, EPSO did not grant the request for information until 16 June 2010, that is to say, when the applicant had already lodged her application.

In its comments to the final disclosure, the applicant argued that the determination not to grant MET to the two related Chinese producers was not made within three months of the initiation of the investigation as provided for in Article 2(7)(c) of the basic Regulation. According to the applicant, this had an influence on the Commission’s decision not to verify the information provided by some of its related companies and by the producer in the analogue country, which had a prejudicial effect on the outcome of the investigation.
