Les noms de variétés à raisins de cuve et leurs synonymes énumérés à l'annexe XV, partie B, du présent règlement qui contiennent partiellement une appellation d'origine protégée ou une indication géographique protégée et font directement référence à l'élément géographique de l'appellation d'origine protégée ou de l'indication géographique protégée en question peuvent figurer uniquement sur l'étiquette d'un produit bénéficiant d'une appellation d'origine protégée ou d'une indication géographique protégée ou d'une indication géographique d'un pays tiers.
4. The wine grape variety names and their synonyms listed in Part B of Annex XV to this Regulation, that partially contain a protected designation of origin or geographical indication and directly refers to the geographical element of the protected designation of origin or geographical indication in question, may only appear on the label of a product with protected designation of origin or geographical indication or geographical indication of a third country.

Therefore, in order to distinguish, within the category of wines without PDO/PGI, those which fall under the sub-category ‘varietal wines’ from those which do not benefit from this openness, specific rules on the use of optional particulars, should be established on one hand for wines with protected designations of origin and geographical indications, and on the other hand for wines without protected designation of origin and geographical indication, bearing in mind that also covers ‘varietal wines’.

nevertheless, where an agricultural or other product or a foodstuff possesses particular characteristics which are due to its geographical origin, it is possible for the producers of the product or foodstuff to apply, through the competent authorities of the Member State concerned, for registration at Community level of a protected designation of origin (PDO) or a protected geographical indication (PGI) in accordance with the provisions of Council Regulation No 510/2006 of 20 March 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs ; the granting of registration means that the Community has recognised the existence of very close links between the specific qualities of the product concerned and its geographical origin; in such cases, the common interest does not oppose the granting of aid for advertising which includes a reference to the origin of the product concerned, provided that the references to origin correspond exactly to those references which have been registered by the Community; similar considerations apply to other designations of origin which are protected under Community legislation, for example wines produced in specified regions in accordance with Articles 54–58 of Council Regulation (EC) No 1493/1999 of 17 May on the common organisation of the market in wine

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission as regards laying down rules on the form of the product specification; laying down detailed rules on the form and content of the register of protected designations of origin and protected geographical indications; defining the technical characteristics of the Union symbols and indications as well as the rules on their use on products, including the appropriate linguistic versions to be used; granting and extending transitional periods for temporary derogations for use of protected designations of origin and protected geographical indication; laying down detailed rules on the form and content of the register of traditional specialities guaranteed; laying down rules for the protection of traditional specialities guaranteed; laying down all measures relating to forms, procedures and other technical details for the application of Title IV; laying down rules for the use of optional quality terms; laying down rules for the uniform protection of indications, abbreviations and symbols referring to the quality schemes; laying down detailed rules on the procedure, form and presentation of applications for registration and of oppositions; rejecting the application; deciding on the registration of a name if an agreement has not been reached; laying down detailed rules on the procedure, form and presentation of an amendment application; cancelling the registration of a protected designation of origin, a protected geographical indication or a traditional speciality guaranteed; and laying down detailed rules on the procedure and form of the cancellation process and on the presentation of the requests for cancellation.

3. Par dérogation à l'article 42, paragraphe 3, du règlement (CE) no 479/2008, les noms de variétés à raisins de cuve et leurs synonymes énumérés à l'annexe XV, partie A, du présent règlement qui contiennent ou consistent en une appellation d'origine protégée ou une indication géographique protégée peuvent figurer uniquement sur l'étiquette d'un produit bénéficiant d'une appellation d'origine protégée ou d'une indication géographique protégée ou d'une indication géographique d'un pays tiers s'ils ont été autorisés conformément aux règles communautaires en vigueur le 11 mai 2002 ou à la date d'adhésion des États membres si cette date est postérieure.
3. By way of derogation from Article 42(3) of Regulation (EC) No 479/2008, the wine grape variety names and their synonyms listed in Part A of Annex XV to this Regulation, that consist of or contain a protected designation of origin or geographical indication may only appear on the label of a product with protected designation of origin or geographical indication or geographical indication of a third country if they were authorised under Community rules in force on 11 May 2002 or on the date of accession of Member States, whichever is later.
