A. whereas a Member of the European Parliament, Alexander Mirsky, has requested the defence of his parliamentary immunity in connection with civil proceedings pending before the Supreme Court of the Republic of Latvia; whereas the proceedings in question relate to the decision of the Civil Division of the Riga District Court (hereinafter referred to as ‘the Riga District Court’) to require Alexander Mirsky to retract a statement made in a speech at the European Parliament on 4 April 2011 and to pay LVL 1000 in non-material compensation to the benefit of the allegedly prejudiced applicants;

A. considérant qu'Alexander Mirsky, député au Parlement européen, a demandé la défense de son immunité parlementaire en relation avec la procédure civile en instance devant la Cour suprême de la République de Lettonie; que la procédure en question se rapporte à la décision de la Chambre civile du Tribunal régional de Riga (ci-après "le Tribunal régional de Riga") de faire obligation à Alexander Mirsky de rétracter une déclaration faite dans une intervention devant le Parlement européen le 4 avril 2011 et de verser 1 000 LVL à titre de réparation du préjudice moral au bénéfice des demandeurs présumés lésés;

– vu la demande déposée par Alexander Mirsky le 14 février 2014, annoncée en plénière le 24 février 2014, pour la défense de son immunité et de ses privilèges en relation avec la procédure civile en instance devant la chambre civile du sénat de la Cour suprême de la République de Lettonie (ci-après «la Cour suprême») (référence C17129611),
– having regard to the request by Alexander Mirsky of 14 February 2014, announced in plenary on 24 February 2014, for the defence of his immunity and privileges in connection with civil proceedings pending before the Civil Division of the Senate of the Supreme Court of the Republic of Latvia (hereinafter referred to as ‘the Supreme Court’) (ref. C17129611),

H. considérant que le Tribunal de la Ville de Jūrmala a reconnu à juste titre qu'Alexander Mirsky jouissait de l'immunité accordée aux députés au Parlement européen conformément à l'article 8 du protocole, et qu'il a donc rejeté la demande des demandeurs; qu'à l'inverse, le Tribunal régional de Riga a complètement ignoré l'applicabilité de cette disposition; qu'une juridiction nationale se doit d'appliquer le droit primaire de l'Union;
H. whereas the Jūrmala Town Court has correctly acknowledged that Alexander Mirsky enjoyed the immunity accorded to the Members of the European Parliament by Article 8 of the Protocol and thus rejected the applicants’ claim; whereas, conversely, the Riga District Court has completely ignored the applicability of that provision; whereas a national court has a duty to apply EU primary law;

J. considérant, en ce qui concerne l'arrêt prononcé par le Tribunal régional de Riga, qu'il s'agit en réalité d'une violation des privilèges et immunités d'Alexander Mirsky; que les circonstances de l'affaire en question constituent en particulier une restriction d'une opinion exprimée dans l'exercice d'activités parlementaires;
J. whereas, further to the judgment of the Riga District Court, there has, in fact, been a breach of the privileges and immunities of Alexander Mirsky; whereas, in particular, the circumstances of the case in point constitute a restriction on an opinion expressed in the performance of his parliamentary duties;
