Lorsqu’ils achètent une voiture dans un autre État membre ou la transfèrent vers un État membre différent de celui où ils l’ont achetée (par exemple à la suite d’un changement de domicile), les citoyens de l’Union sont fréquemment confrontés à de lourdes formalités administratives en vue de sa réimmatriculation ainsi que, le cas échéant, à un double paiement de la taxe d’immatriculation, les législations nationales sur la taxation de la première immatriculation étant appliquées sans aucune coordination.
When buying a car in another Member State or transferring it to a Member State different from that where it was bought (e.g. when changing residence), EU citizens are frequently faced with cumbersome re-registration formalities and paperwork and, possibly, double payment of registration tax, because national laws on taxation of the first registration are applied in an uncoordinated manner.

Eu égard aux dispositions de la loi no 9/2012 et à l’objet de la taxe prévue par cette loi, est-il nécessaire de considérer que l’article 110 TFUE doit être interprété en ce sens qu’il s’oppose à ce qu’un État membre de l’Union institue une taxe sur les émissions polluantes applicable à l’immatriculation des véhicules provenant d’un autre État de l’Union, taxe qui, dans le cas des véhicules nationaux, n’est due que lors du transfert du droit de propriété sur un tel véhicule, ce qui a pour conséquence qu’un véhicule étranger ne peut pas être utilisé sans paiement de la taxe, tandis qu’un véhicule national peut être utilisé de manière illimitée dans le temps sans paiement de la taxe, jusqu’au moment du transfert du droit de propriété sur ledit véhicule suivi par l’immatriculation du nouveau propriétaire, si un tel transfert a lieu?
In the light of Law No 9/2012 and the purpose of the tax provided for thereunder, must Article 110 TFEU be interpreted as precluding a Member State of the European Union from establishing a tax on pollutant emissions, applicable upon the registration of motor vehicles from another Member State of the European Union, but which, in the case of domestic motor vehicles, is payable only upon the transfer of ownership of such vehicles, the result being that a foreign vehicle cannot be used unless the tax is paid, but a domestic vehicle can be used for an unlimited time without the tax being paid, until the ownership of that vehicle is transferred, if ever, followed by its registration in the name of the new owner?

Eu égard aux dispositions de la loi no 9/2012 et à l’objet de la taxe prévue par cette loi, est-il nécessaire de considérer que l’article 110 TFUE doit être interprété en ce sens qu’il s’oppose à ce qu’un État membre de l’Union institue une taxe sur les émissions polluantes applicable à l’immatriculation des véhicules provenant d’un autre État de l’Union, taxe qui ne s’applique pas à l’immatriculation lors du transfert du droit de propriété sur les véhicules nationaux pour lesquels une telle taxe ou une taxe similaire a déjà été payée, dans les conditions où la valeur de cette taxe résiduelle incorporée dans la valeur des véhicules se trouvant sur le marché interne est inférieure à la nouvelle taxe?
In the light of Law No 9/2012 and the purpose of the tax provided for thereunder, must Article 110 TFEU be interpreted as precluding a Member State of the European Union from establishing a tax on pollutant emissions, applicable upon the registration of motor vehicles coming from another Member State of the European Union, where that tax does not apply to the registration of domestic motor vehicles, upon the transfer of ownership of such vehicles, in respect of which such a tax or a similar tax has already been paid, where the amount of such a residual tax incorporated into the value of the motor vehicles on the domestic market is lower than the new tax?

Le présent règlement s'applique aux véhicules à moteur de catégorie N1, tels qu'ils sont définis à l'annexe II de la directive 2007/46/CE, dont la masse de référence ne dépasse pas 2 610 kg, et aux véhicules de catégorie N1 auxquels la réception par type est élargie conformément à l'article 2, paragraphe 2, du règlement (CE) no 715/2007 (ci-après dénommés «véhicules utilitaires légers»), qui sont immatriculés dans l'Union pour la première fois sans avoir été immatriculés auparavant en dehors de l'Union (ci-après dénommés «véhicules utilitaires légers neufs»).

This Regulation shall apply to motor vehicles of category N1 as defined in Annex II to Directive 2007/46/EC with a reference mass not exceeding 2 610 kg and to vehicles of category N1 to which type-approval is extended in accordance with Article 2(2) of Regulation (EC) No 715/2007 (‘light commercial vehicles’) which are registered in the Union for the first time and which have not previously been registered outside the Union (‘new light commercial vehicles’).

To ensure consistency with Regulation (EC) No 443/2009 and to avoid abuses, the target should be applied to new light commercial vehicles registered in the Union for the first time and that have not previously been registered outside the Union except for a limited period.

Il convient que les États membres contrôlent le nombre de véhicules immatriculés selon ces procédures afin d’évaluer leur impact sur le processus de contrôle et l’accomplissement de l’objectif moyen d’émissions de CO de l’Union européenne pour la flotte de voitures particulières neuves.
Member States should monitor the number of vehicles registered under those procedures in order to assess its impact on the monitoring process and the attainment of the EU’s average CO emissions target for the new passenger car fleet.

Conformément aux articles 18 et 26 de la directive 2007/46/CE du Parlement européen et du Conseil du 5 septembre 2007 établissant un cadre pour la réception des véhicules à moteur, de leurs remorques et des systèmes, des composants et des entités techniques destinés à ces véhicules , le constructeur doit veiller à ce que chaque voiture particulière neuve mise sur le marché de l’Union européenne soit accompagnée d’un certificat de conformité en cours de validité, et les États membres ne peuvent immatriculer ces véhicules que s’ils sont accompagnés d’un tel certificat de conformité.
Pursuant to Articles 18 and 26 of Directive 2007/46/EC of the European Parliament and of the Council of 5 September 2007 establishing a framework for the approval of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles , a manufacturer must ensure that each new passenger car placed on the market in the EU is accompanied by a valid certificate of conformity and a Member State cannot register such a vehicle unless it is accompanied by such a certificate of conformity.
