Notes that the recent inevitable increase in trade disputes between Europe and the United States (the Helms-Burton and Amato-Kennedy Acts, the McDonnell-Boeing merger and exclusive contracts, the gas contract with Iran, etc.) show the need for the Europeans, following the example of the Americans, to have a legal mechanism permitting the use, if necessary, of credible threats of reprisal, with the aim of reaching compromises which genuinely take account of European concerns and interests;

Le Conseil rappelle en particulier à cet égard la profonde inquiétude qu'il avait exprimée dans ses conclusions du 15 juillet 1996 au sujet des effets extraterritoriaux des lois Helms-Burton et d'Amato.
The Council recalls in particular in this regard the deep concern it expressed in its conclusions of 15 July 1996 over the extraterritorial effects of the Helms-Burton and d'Amato Acts.

Given the Understanding reached between the Commission and the US and the commitments undertaken in it by the US, the Council agreed that the current WTO panel proceedings in respect of the Helms-Burton (Libertad) legislation will now be suspended and that, if action is taken against EU companies or individuals under the Libertad Act or under the Iran and Libya Sanctions Act (ILSA), or waivers as described in the Understanding are not granted, or are withdrawn, the Commission will request the WTO to restart, or to re-establish, the panel, which will then follow its natural course.
