The Ombudsman found that the Group of Thirty's membership, funding, and aims are too diverse for it to be regarded as an interest group: fewer than one third of the current members of the group come from the private sector (other members are from the public sector and academia); it receives funding from a diverse range of public, as well as from private, sources; and the topics it deals with, and the speakers it chooses, are very diverse as well. Mme Kaufmann et Mme Buitenweg étaient d’avis qu’un accord avait été conclu dans le dos des groupes plus petits, mais je voudrais leur rappeler que la gauche unitaire européenne et les Verts avaient déjà rejeté le compromis de la commission. En outre, il n’est pas très productif d’entamer des négociations avec des groupes catégoriquement opposés à une proposition. Mrs Kaufmann and Mrs Buitenweg were of the opinion that a deal had been done behind the backs of the smaller groups, but I would like to remind them that the European United Left and the Greens had already rejected the Committee’s compromise, and it is hardly productive to initiate negotiations with groups that are categorically opposed to a proposal; after all, they, as a matter of principle, will negotiate on all other matters with any group other than the Group of the European People’s Party.

In the present situation, the Article 29 Working Party took the view in its opinion 6/2002 of 24 October 2002 that consent should not be relied on and that the exception to the "adequate protection" requirement provided for in Article 26 (1) (a) of the Directive ("the data subject has given his consent unambiguously to the proposed transfer") did not therefore provide a sound legal solution.
