More specifically, Mr Patriciello was charged with having played a role in directing, controlling and supporting the actions of the chair of Neuromed and the legal representative of the 'Paola Pavone' Foundation who, on 11 September 2000, drew up a contract for the free use of the 'offending' institute located in the municipality of Salcito, between the 'Paola Pavone' Foundation (owner and builder of the building in question) and the Neuromed, in order to allow the latter welfare and research institution to run the facility in question ‘for its own profit (...) as an “advanced rehabilitation centre” under (temporary) accreditation arrangements with the Region, excluding any form of social or welfare provision’; the institute in question, moreover, had allegedly ‘already been built thanks also to disbursement by the Region of a substantial sum (ITL 1 400 000 000) tied to the operation of the institute (also) as a social and health care institute’ and was run ‘as if it were a private enterprise under political patronage, also seeking, through the “satellite sectors” that are inevitably linked to such an operation (recruitment, business for local shops, various companies, businesses, etc.) to acquire and/or consolidate political consensus, especially locally, and to embezzle the financing already obtained – using that funding for very different purposes that were totally incompatible with those for which it had been granted.

6. Le conseil de direction notifie, dans les meilleurs délais, à l'autorité budgétaire son intention de réaliser tout projet susceptible d'avoir des incidences financières significatives sur le financement du budget de la Fondation, notamment les projets de nature immobilière, tels que la location ou l'acquisition d'immeubles.

The Governing Board shall, as soon as possible, notify the budgetary authority of its intention to implement any project which may have significant financial implications for the funding of the Foundation's budget, in particular any projects relating to property, such as the rental or purchase of buildings.

Welcomes the recent adoption by the Turkish parliament of the Law on Foundations; welcomes the Commission's intention to examine the new text, and underlines that it should analyse whether the Law addresses all shortcomings faced by non-Muslim religious communities with regard to property management and acquisition, including confiscated property sold to third parties; calls on the Turkish authorities to ensure that the Law is implemented in line with the ECHR and the case-law of the European Court of Human Rights;

La modification du régime des personnes juridiques ne résout pas le problème des restrictions légales au droit d'association ni celui de la loi sur les fondations, récemment ratifiée par la cour suprême, qui interdit aux fondations de minorités religieuses non musulmanes d'acquérir des biens immeubles en Turquie.
The amendment of the status of legal persons does not solve the problem of the legal obstacles to the right of association or to the law on foundations, recently ratified by the Supreme Court, prohibiting the acquisition of property by foundations run by non-Muslim religious minorities in Turkey.

The Commission proposal provides for the following: with respect to cultural workers: a system for spreading such workers' incomes over several tax years in applying income taxes; with respect to cultural foundations: appropriate tax exemption for cultural foundations approved by Member States; with respect to patronage: appropriate tax deductions for gifts and bequests to approved cultural bodies or institutions, and tax deductions applicable to patronage where a cash gift or bequest is made to an approved body or person in a Member State other than that in which the patron is resident; with respect to succession duty: the system whereby succession duty can be settled through the surrender of works of art approved by the competent authorities; with respect to the private architectural heritage: an abatement from the valuee of buildings forming part of that heritage which are subject to "cultural servitudes" arising either from legislation relating to listed buildings or from the fact that they are open to the public, where that value serves as a basis for calculating such taxes as land tax, transfer dduty, annual wealth tax and succession duty; and the deduction from the taxable incomes of the taxpayers concerned of expenditure inccurred in conserving and maintaining those buildings; with respect to cultural investments: a system which does not impose tax disadvantages on cultural investments, and in particular will eliminatee possible tax obstacles to the development of cinema and television co-productions; with respect to widening the audiance: that the Member States will not discourage demand for cultural goods and services by applying high rates of value added tax or of other taxes (1) COM(85) 194 - 2 - The Commission has chosen to couch its proposal in the form of a Resolution so that the Council and the Ministers responsible for Cultural Affairs meeting within the Council can enter into a definite political commitment which at the same time forms the f ...
