TRADUCTIONS EN CONTEXTE

réaffirme que l'adhésion de l'UE à la Convention des droits de l'homme constituera le niveau de protection minimal des droits de l'homme et des libertés fondamentales en Europe et apportera un mécanisme supplémentaire pour faire respecter les droits de l'homme, à savoir la possibilité d'introduire un recours auprès de la Cour européenne des droits de l'homme contre un acte contraire aux droits de l'homme d'une institution de l'UE ou d'un État membre dans l'application du droit de l'UE et que la jurisprudence de la Cour européenne des droits de l'homme, et que la Cour européenne des droits de l'homme apportera une contribution notable à l'action actuelle et à venir de l'UE en matière de respect et de promotion des libertés fondamentales dans les domaines des libertés publiques, de la justice et des affaires intérieures, en plus de la jurisprudence de la Cour de justice en la matière;
Reaffirms that EU accession to the ECHR will constitute the minimum level of protection for human rights and fundamental freedoms in Europe and provide an additional mechanism for enforcing human rights, namely the possibility of lodging a complaint with the ECtHR in relation to a violation of human rights derived from an act by an EU institution or a Member State implementing EU law, falling within the remit of the ECHR; and that ECtHR case law will thus provide extra input for current and future EU action on the respect for, and promotion of, fundamental freedoms in the areas of civil liberties, justice and home affairs, in addition to the case law of the Court of Justice in this field;

Chaque État membre devrait garantir dans son droit national un niveau de protection approprié des données correspondant au moins à celui résultant de la convention du Conseil de l'Europe du 28 janvier 1981 relative à la protection des personnes à l'égard du traitement automatisé des données à caractère personnel et de la jurisprudence correspondante établie dans le cadre de l'article 8 de la convention de sauvegarde des droits de l'homme et des libertés fondamentales, ainsi que, pour les États membres qui l'ont ratifié, du protocole additionnel du 8 novembre 2001 à ladite convention du Conseil de l'Europe, et devrait tenir compte de la recommandation no R (87) 15 du comité des ministres du Conseil de l'Europe du 17 septembre 1987 visant à réglementer l'utilisation de données à caractère personnel dans le secteur de la police.
Each Member State should ensure an adequate data protection level in its national law which at least corresponds to that resulting from the Council of Europe Convention of 28 January 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data and the corresponding case law pursuant to Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms and, for those Member States which have ratified it, the Additional Protocol of 8 November 2001 to that Convention, and should take into account Recommendation No R (87) 15 of 17 September 1987 of the Committee of Ministers of the Council of Europe Regulating the Use of Personal Data in the Police Sector.
