Due to the need to comply with international agreements, the Commission should be empowered to modify the technical procedures for the calculation methods concerning thresholds as well as to periodically revise the thresholds themselves; references to the CPV nomenclature may undergo regulatory changes at Union level and it is necessary to reflect those changes into the text of this Directive; the technical details and characteristics of the devices for electronic receipt should be kept up to date with technological developments; it is also necessary to empower the Commission to make mandatory certain technical standards for electronic communication to ensure the interoperability of technical formats, processes and messaging in procurement procedures conducted using electronic means of communication taking into account technological developments; the Commission should also be empowered to adapt the list of legislative acts of the Union establishing common methodologies for the calculation of life-cycle costs; the list of International Social and Environmental Conventions and the list of Union legislation whose implementation creates a presumption of free access to a given market as well as Annex II„ setting out a list of legal acts to be taken into account when assessing the existence of special or exclusive rights, should be quickly adapted to incorporate the measures adopted on a sectoral basis.

(30) Pour garantir des conditions uniformes de mise en œuvre du présent règlement, notamment en ce qui concerne l’exercice des compétences dévolues aux autorités nationales de surveillance, la fourniture de services d’appui sur une base exclusive par un prestataire de services ou un groupement de prestataires de services, les mesures correctives destinées à garantir le respect des objectifs de performance au niveau de l’Union et des objectifs de performance correspondants à l'échelon local, le contrôle de conformité appliqué au système de redevances, la gouvernance et l’adoption de projets communs pour les fonctions liées au réseau, les blocs d’espace aérien fonctionnels, les modalités de participation des parties prenantes aux grandes décisions opérationnelles des prestataires de services de navigation aérienne, l’accès aux données et la protection des données, l’information aéronautique par voie électronique et le développement technologique et l’interopérabilité de la gestion du trafic aérien, il y a lieu de conférer des compétences d’exécution à la Commission.
(30) In order to ensure uniform conditions for the implementation of this Regulation, in particular with regard to the exercise of their powers by national supervisory authorities, provision of support services on an exclusive basis by a service provider or groupings thereof , corrective measures to ensure compliance with the Union-wide and associated local performance targets, review of compliance in relation to the charging scheme, governance and adoption of common projects for network related functions, functional airspace blocks, modalities of participation of stakeholders in major operational decisions of the air navigation service providers, access to and protection of data, electronic aeronautical information and technological development and interoperability of air traffic management, implementing powers should be conferred on the Commission.

With a view to promoting private investment in research and innovation, Member States and the Union should improve framework conditions — notably with regard to the business environment, competitive and open markets, and the high economic potential of the cultural and creative industries — combine, as appropriate, cost-effective fiscal incentives, depending on each Member State’s fiscal room for manoeuvre, and other financial instruments with measures to facilitate access to private finance (including risk-capital) and simplify access for SMEs, boost demand, in particular in eco-innovation, (where appropriate through green public procurement and interoperable standards), promote innovation-friendly markets and regulations, and provide efficient, affordable and effective protection and management of intellectual property.

There are various types of digital decoders on the market, which can broadly be classified by their features and functions: (a) simple decoding of digital programmes, on either the terrestrial or satellite platform; (b) interactivity (possibility of sending information to the broadcasters); (c) conditional access (possibility of decoding pay-TV services); (d) interoperability (the possibility of using the same decoders to receive programmes from different broadcasters on the same platform).

2. Les fournisseurs de services de navigation aérienne qui ont indiqué dans leur lettre d’accord qu’ils mettront en œuvre les procédures de notification, de coordination initiale, de révision de la coordination, d’annulation de la coordination, de données de vol de base ou de changement des données de vol de base entre les unités ATC autres que les ACC, veillent à ce que les systèmes visés à l’article 1er, paragraphe 2, point a), soient conformes aux exigences en matière d’interopérabilité et de performance définies à l’annexe I, parties A et B.
2. Air navigation service providers that have specified in their letter of agreement that they will implement the notification, the initial coordination, the revision of coordination, the abrogation of coordination, the basic flight data or the change to basic flight data processes between ATC units other than ACCs, shall ensure that the systems referred to in Article 1(2)(a), comply with the interoperability and performance requirements specified in Annex I, Parts A and B.

ALSO CONSIDERS the following points particularly urgent: - Rapid enactment of the liberalization of voice telephony by means of specific legal measures in accordance with the Council Resolution of 22 July 1993 and measures intended to guarantee the provision of universal service in accordance with the Council Resolution of 7 February 1994; - Acceleration of the European standardization process in an international context, particularly with a view to being able to respond to market trends more effectively; - Protection of intellectual property rights as related to the information society; - Issues concerning security of information systems; - Continuing activities on an international basis (e.g. trade issues, market access, interoperability, cooperation) and notably obtaining in GATT negotiations on Basic Telecommunications effective and comparable access to third countries' markets concerning services and infrastructures; - Improvement of the competitiveness of the European audiovisual and information industry in the world market, including the necessary development of a European programmes industry taking due account of the cultural specificities and impacts on the society of these programmes; - Issues concerning privacy; - Early setting up by the Member States and the Commission of the permanent coordination instrument referred to in the conclusions of the Corfu European Council.

From that debate it emerged that a large majority of delegations felt that in view of the objectives pursued, namely the free movement of goods, capital, persons and services and, on the other hand, the stress laid in the Treaty on the interconnection and interoperability of trans- European networks the telecommunications infrastructure and the networks of which it consists include all the physical and non-physical components required to make possible the circulation of information in all its different forms (vocal, written and visual), namely: - the medium for the transmission of data, consisting of the physical network (cables and radio connections) with which the non-physical functions are connected (transmission, switching and signalling); - generic services, which constitute the general-purpose vehicles for the data transmitted (electronic mail and access to data bases); - applications services, which adapt generic services to users' specific requirements (e.g. inter-administration networks and networks associated with transport, health care and distance teaching).
