Les ressources du fonds Capacité et innovation («Capability and Innovation Fund») seront allouées aux banques concurrentes éligibles afin qu'elles puissent renforcer leur capacité à concurrencer RBS sur le marché de la fourniture des services bancaires aux PME et/ou développer et améliorer les produits et services financiers qu'elles proposent aux PME.
The Capability and Innovation Fund will be distributed to eligible challengers to develop their capability to compete with RBS in the provision of banking services to SMEs and/or develop and improve their financial products and services available to SMEs.

3. Les États membres exigent que les entreprises d'investissement maintiennent en vigueur, pour décider de l'éventail des instruments et services financiers qu'elles proposent ou recommandent et des différents marchés cibles, des procédures et des mesures assurant le respect de toutes les exigences applicables de la directive 2014/65/UE, y compris celles relatives à la publication, à l'évaluation de l'adéquation ou du caractère approprié, à la détection et à la gestion des conflits d'intérêts, et aux incitations.
3. Member States shall require investment firms, when deciding the range of financial instrument and services that they offer or recommend and the respective target markets, to maintain procedures and measures to ensure compliance with all applicable requirements under Directive 2014/65/EU including those relating to disclosure, assessment of suitability or appropriateness, inducements and proper management of conflicts of interest.

La Commission souhaiterait que les parties prenantes lui indiquent : si elles sont d’accord avec les nouveaux domaines prioritaires identifiés ; quels sont les avantages et les inconvénients des différents modèles de prestation transfrontalière de services, si le modèle du 26e régime est économiquement viable et quelles activités pourraient y trouver avantage ; comment permettre aux consommateurs d’utiliser plus efficacement les produits financiers et si cela implique qu’il faut plus de conseils professionnels et indépendants et une meilleure formation en matière de services financiers ; si elles sont d’accord avec les questions identifiées dans la liste de produits de détail ci-dessus, ou si elles proposent d’autres domaines où une action supplémentaire au niveau de l’UE serait bénéfique.
The Commission would be interested to learn from stakeholders: whether they agree with the new identified priority areas; what are the (dis)advantages of the various models for cross-border provision of services, whether there is a business case for developing a 26th regime, and which business lines might benefit; how to enable consumers to deal more effectively with financial products and whether this means more professional and independent advice, improved education or financial literacy training are needed; whether they agree with the issues identified in the above list of retail products, or if they would suggest other areas where additional action at EU level could be beneficial.

Tout entreprise d’investissement comprend les instruments financiers qu’elle propose ou recommande, évalue la compatibilité des instruments financiers avec les besoins des clients auxquels elle fournit des services d’investissement, compte tenu notamment du marché cible défini de clients finaux visé à l’article 16, paragraphe 3, et veille à ce que les instruments financiers ne soient proposés ou recommandés que lorsque c’est dans l’intérêt du client.
An investment firm shall understand the financial instruments they offer or recommend, assess the compatibility of the financial instruments with the needs of the clients to whom it provides investment services, also taking account of the identified target market of end clients as referred to in Article 16(3), and ensure that financial instruments are offered or recommended only when this is in the interest of the client.

Une entreprise d’investissement examine aussi régulièrement les instruments financiers qu’elle propose ou commercialise, en tenant compte de tout événement qui pourrait influer sensiblement sur le risque potentiel pesant sur le marché cible défini, afin d’évaluer au minimum si l’instrument financier continue de correspondre aux besoins du marché cible défini et si la stratégie de distribution prévue demeure appropriée.
An investment firm shall also regularly review financial instruments it offers or markets, taking into account any event that could materially affect the potential risk to the identified target market, to assess at least whether the financial instrument remains consistent with the needs of the identified target market and whether the intended distribution strategy remains appropriate.

Les entreprises d’investissement qui proposent ou recommandent à leurs clients des instruments financiers qu’elles ne fabriquent pas devraient également disposer de modalités appropriées pour obtenir et comprendre les informations utiles concernant le processus de validation du produit, y compris le marché cible défini et les caractéristiques du produit qu’elles proposent ou recommandent.
Investment firms that offer or recommend to clients financial instruments not manufactured by them should also have appropriate arrangements in place to obtain and understand the relevant information concerning the product approval process, including the identified target market and the characteristics of the product they offer or recommend.

Lorsqu’une entreprise d’investissement propose ou recommande des instruments financiers qu’elle ne conçoit pas, elle se dote de dispositifs appropriés pour obtenir les renseignements visés au cinquième alinéa et pour comprendre les caractéristiques et identifier le marché cible défini de chaque instrument financier.
Where an investment firm offers or recommends financial instruments which it does not manufacture, it shall have in place adequate arrangements to obtain the information referred to in the fifth subparagraph and to understand the characteristics and identified target market of each financial instrument.
