39. rappelle aux États membres les obligations qui leur incombent en vertu de la position commune de l'UE sur les exportations d'armements (2008/944/PESC), qui exige notamment qu'ils refusent l'autorisation d'exportation de technologie ou d'équipements militaires aux pays voisins s'il existe un risque manifeste que la technologie ou les équipements militaires dont l'exportation est envisagée soient utilisés à des fins de répression interne ou servir à commettre des violations graves du droit humanitaire international, soient susceptibles de provoquer ou de prolonger des conflits armés ou d'aggraver des tensions ou des conflits existants dans le pays de destination finale, ou que leur exportation soit envisagée comme une provocation à l'égard d'un autre pays ou pour faire valoir par la force une revendication territoriale;
39. Reminds the Member States of their obligations under the EU Common Position on arms exports (944/2008), which inter alia requires them to deny an export licence for military technology or equipment to any neighbourhood country if there is a clear risk that the military technology or equipment to be exported might be used for internal repression or in committing serious violations of international humanitarian law, would provoke or prolong armed conflicts or aggravate existing tensions or conflicts in the country of final destination, or would be exported aggressively against another country or used to assert a territorial claim by force;

212. rappelle que la Task Force d'enquête (Investigation Task Force – ITF), créée pour enquêter sur les irrégularités financières et la fraude relatives aux fonds de l'Union européenne au Kosovo, a mis un terme à ses activités en août 2008, que son rapport final a conclu à des actes crapuleux de la part, notamment, du personnel des Nations unies, et que plusieurs mandats d'arrêt internationaux ont été lancés, sans qu'aucun résultat n'ait été obtenu à cet égard par les Nations unies; invite la Commission à faire pression afin que ces mandats soient exécutés; invite la Commission à présenter, en outre, un rapport sur le suivi judiciaire de toutes les affaires décelées; demande la création d'une organisation appelée à succéder à l'ITF pour lutter contre la fraude et les irrégularités impliquant la Commission et l'OLAF;
212. Recalls that the Investigation Task Force (ITF) established to investigate financial irregularities and fraud concerning EU funds in Kosovo finished its operations in August 2008, that its final report identified criminal conduct on the part of, among others, United Nations staff, and that several international warrants were issued without any results being achieved in that regard by the United Nations; asks the Commission to press for the execution of these warrants; asks the Commission, further, to present a report on the legal follow-up to all cases discovered; calls for the establishment of a successor organisation, involving the Commission and OLAF, in the fight against fraud and irregularity;

Les distributeurs d'énergie, les gestionnaires de réseaux de distribution et les entreprises de vente d'énergie au détail peuvent améliorer l'efficacité énergétique dans la Communauté si les services énergétiques qu'ils commercialisent comprennent une utilisation finale efficace, tels que le confort thermique dans les bâtiments, la production d'eau chaude à usage domestique, la réfrigération, la fabrication de produits, l'éclairage et la force motrice.
Energy distributors, distribution system operators and retail energy sales companies can improve energy efficiency in the Community if the energy services they market include efficient end-use, such as indoor thermal comfort, domestic hot water, refrigeration, product manufacturing, illumination and motive power.

4. L'utilisation des marchandises énumérées à l'annexe I à des fins de formation ou l'utilisation temporaire de ces marchandises à l'intérieur du territoire douanier de la Communauté par des forces armées ou d'autres forces à des fins civiles, en cas de force majeure ou de catastrophes naturelles, n'est pas contraire à l'utilisation finale définie au paragraphe 1.
4. The use of the goods listed in Annex I for training purposes or the temporary use of these goods in the customs territory of the Community by the military forces or other forces for civil purposes due to unforeseen or natural disasters shall not constitute a violation of the end use determined in paragraph 1.
