(8) Where it is found that facts which may constitute criminal offences, brought to light by the final report on an internal investigation, cannot, on account of their nature, because they are not serious enough or because the financial loss was only minor, be effectively dealt with before the courts, the Director-General of the Office should transmit the final report direct to the institution, body, office or agency concerned in order that more appropriate action then be taken.

3 bis. Lorsque le rapport établi à la suite d'une enquête interne révèle des informations sur des faits susceptibles de poursuites pénales, le rapport final est transmis aux autorités judiciaires de l'État membre concerné et, sans préjudice des dispositions nationales relatives aux procédures judiciaires, à l'institution, à l'organe ou à l'organisme concerné conformément au paragraphe 4.
Where the report drawn up after an internal investigation contains information pertaining to facts which could give rise to criminal proceedings, the final report shall be transmitted to the judicial authorities of the Member State concerned and, without prejudice to national provisions on judicial procedures, to the institution, body, office or agency concerned in accordance with paragraph 4.

12. 12. Where it is found that facts brought to light by the final report on an internal investigation could give rise to criminal proceedings, this information should be transmitted to the national judicial authorities of the Member State concerned, unless internal measures allowing for more appropriate follow-up action are available, in the light of the nature of the facts and the scale of the financial impact.
