The concept of territorial integrity, which is constantly invoked to deny our aboriginal rights and their expression on the land, corresponds to the concept of legislative and regulatory effectiveness in order, in some extent, to limit the self-government that we could eventually achieved.

103. rappelle les inquiétudes exprimées dans le rapport du Haut Commissariat des Nations unies aux droits de l'homme (HCDH) de 2006 qui a fuité officieusement concernant les restrictions de la liberté d'expression, d'association et de réunion au Sahara occidental; observe que le Maroc prétend autoriser les sit-in et d'autres formes de protestation; déplore l'apparente obstruction institutionnelle pratiquée par le Maroc à l'encontre des ONG qui adoptent une position favorable à l'indépendance en empêchant leur enregistrement légal et leur reconnaissance, ce qui est nécessaire pour plaider efficacement dans leurs communautés; condamne les sanctions souvent sévères infligées en cas d'«atteinte à l'intégrité territoriale du Maroc», un élément de législation qui serait utilisé pour cibler les Sahraouis militant pacifiquement pour l'indépendance; rappelle les conclusions de l'expert indépendant des Nations unies sur les droits culturels selon lesquelles les autorités marocaines suppriment certains aspects de la culture sahraouie; demande, à l'instar de l'expert indépendant des Nations unies, d'annuler ces mesures et de promouvoir une pleine diversité culturelle; observe avec satisfaction, dans ce contexte, les dispositions relatives au respect des droits culturels qui ont été incluses dans la nouvelle Constitution marocaine; salue la mise en place d'une chaîne de télévision sahraouie; encourage vivement la pleine mise en œuvre de ces dispositions;

Reiterates the concerns of the unofficially leaked 2006 OHCHR report, about restrictions on freedom of speech, assembly and association in Western Sahara; notes Morocco’s claim to allow sit-in demonstrations and other forms of protest; regrets Morocco’s apparent institutional obstruction of NGOs advocating a pro-independence position by preventing their legal registration and recognition, which is necessary to advocate effectively in their communities; condemns the often severe punishments for ‘undermining Moroccan territorial integrity’, an item of legislation reportedly used to target Sahrawis peacefully advocating independence; recalls the findings of the UN Independent Expert on cultural rights that the Moroccan authorities suppress certain aspects of Sahrawi culture; repeats the UN Independent Expert’s call to overturn such measures and to promote full cultural diversity; notes positively, in this connection, the provisions on respect for cultural rights that have been included in the new Moroccan constitution; welcomes the setting-up of a dedicated Sahrawi television station; encourages strongly the full implementation of these provisions;
