Suite aux conclusions adoptées par le Conseil européen de Bruxelles des 20 et 21 mars 2003, qui demandaient l'adoption d'un plan d'action concernant l'amélioration du droit des sociétés et le gouvernement d'entreprise, la Commission adresse la présente Communication au Parlement européen et au Conseil et la transmet également au Comité économique et social européen et au Comité des régions.
Further to the conclusions adopted by the Brussels European Council of 20 and 21 March 2003, which requested the adoption of an Action Plan on Company Law and Corporate Governance, the Commission addresses this Communication to the European Parliament and the Council, and transmits it also to the European Economic and Social Committee and the Committee of the Regions.

Deux ou trois raisons la justifie donc tout particulièrement et je les cite : le déséquilibre entre le volume croissant des affaires et la capacité technique et humaine des juridictions de Luxembourg ; la stricte obligation du multilinguisme de la procédure, qui est le corollaire du respect de la langue et des traditions juridiques nationales ; enfin le fait que ce tribunal - le Tribunal de première instance - est la seule instance à laquelle les citoyens et les entreprises peuvent s'adresser en matière de contentieux économique quant aux décisions d'organes qui les affectent.
These reasons do, however, justify such a reform, particularly two or three of them, which I shall now mention. The first is the imbalance between the increasing volume of cases, the technical and human capacity of the courts in Luxembourg and the strict obligation to adhere to multilingual proceedings, which is the natural consequence of respect for each country’s language and legal traditions. The last reason is that this court, the Court of First Instance, is the only instance to which individuals and companies have recourse on economic disputes with regard to decisions by the bodies which affect them.
