This Directive respects fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union (the ‘Charter’) and in particular the right to liberty and security, the protection of personal data, the freedom to choose an occupation and right to engage in work, the freedom to conduct a business, the right to property, the right to an effective remedy and to a fair trial, the presumption of innocence and the right of defence, the principles of the legality and proportionality of criminal offences and sanctions, as well as the principle of ne bis in idem.

(70) This Regulation respects the fundamental rights and observes the principles recognised in the Charter of Fundamental Rights of the European Union, in particular the right to property, the protection of personal data, the freedom to conduct a business, employees’ right to information and consultation within the undertaking, the right to an effective remedy and to a fair trial, and has to be implemented in accordance with those rights and principles.

Je pense qu’une coopération entre entreprises de droit public et entreprises privées, qui profiterait du savoir-faire et des capitaux privés, constitue une option positive pour une utilisation des ressources en eau optimale, à la fois du point de vue écologique et du point de vue économique, sans pour autant renoncer aux secteurs de distribution régionaux.
I believe that cooperation between public and private undertakings using private know-how and capital is an option when it comes to making the best use of water resources from an ecological and economic point of view, without regional supply zones being given up.

Cependant, malgré les discriminations éventuellement perçues par les entreprises, le droit communautaire n'empêche pas les États membres de faire preuve de discrimination à l'encontre de "leurs" propres entreprises ou des entreprises établies sur leur territoire, sauf si l'on établit que cette discrimination vise les sources sous contrôle étranger ou l'accès au marché des nouveaux entrants étrangers.
However, notwithstanding the possible perceived discrimination by companies, Community law does not prevent Member States from discriminating against "their" own companies, or companies established on their territory, unless bias can be demonstrated discriminating against "foreign" owned sources, or the entry into the market of "foreign" new entrants.
