La situation en cause en l'espèce se distingue par conséquent de celle prévalant dans l'affaire PreussenElektra (12), dans le cadre de laquelle la Cour s'est contentée d'examiner si «l'obligation, faite à des entreprises privées d'approvisionnement en électricité, d'acheter à des prix minimaux fixés l'électricité produite à partir de sources d'énergie renouvelables n'entraînait aucun transfert direct ou indirect de ressources d'État aux entreprises productrices de ce type d'électricité» (13).
Thus, the present case is different from the situation in PreussenElektra (12), where the Court only examined whether an ‘obligation imposed on private electricity supply undertakings to purchase electricity produced from renewable energy sources at fixed minimum prices’ involved ‘any direct or indirect transfer of State resources to undertakings which produce that type of electricity’ (13).

Similarly, Germany explained that, for the purpose of calculating electricity costs, average retail electricity prices were not available for all undertakings, at least not for higher consumption bands; instead, the calculation of electricity costs would be based on the actual electricity costs incurred in the years 2011 and 2012, as those figures were the ones submitted by the undertakings in their applications for the reductions in 2013 and 2014.

For the purposes of Article 9(1)(b), the notion ‘undertaking performing any of the functions of generation or supply’ shall not include final customers who perform any of the functions of generation and/or supply of electricity, either directly or via undertakings over which they exercise control, either individually or jointly, provided that the final customers including their shares of the electricity produced in controlled undertakings are, on an annual average, net consumers of electricity and provided that the economic value of the electricity they sell to third parties is insignificant in proportion to their other business operations.
