Au cas où un projet de règles techniques nationales pourrait apparaître comme justifié au titre de l'article 36 mais entraînerait néanmoins l'apparition d'entraves aux échanges intracommunautaires, la Commission pourrait alors obliger l'État membre à reporter de douze mois l'adoption de ses règles techniques afin de permettre à la Commission de proposer un texte législatif communautaire à cet égard.
In the case where a national draft regulation might be justified under Article 36 but might nonetheless create barriers to intra-Community trade, the Commission can henceforth oblige the Member State to suspend the adoption of its technical regulation for a period of 12 months to enable the Commission to initiate Community legislation on the subject.
