xxi) sachant que les entreprises européennes, et les PME singulièrement, souhaitent vivement pouvoir accéder sans discrimination aux marchés publics aux États-Unis, à l'échelle fédérale et infra-fédérale, par exemple dans le domaine de la construction, du génie civil, des infrastructures de transport et d'énergie et des biens et services, défendre une position ambitieuse sur le chapitre des marchés publics, tout en veillant à la conformité du chapitre avec les nouvelles directives de l'Union en matière de marchés publics et de contrats de concession, afin de remédier, conformément au principe de réciprocité, à la grande disparité existant actuellement dans le degré d'ouverture des deux marchés des commandes publiques de part et d'autre de l'Atlantique en ouvrant sensiblement le marché américain (qui reste régi par le Buy American Act de 1933) aux niveaux fédéral et infra-fédéral dans le prolongement des engagements pris dans l'Accord sur les marchés publics (AMP) et en mettant fin aux restrictions actuellement en vigueur au niveau de la fédération, des États et de l'échelon local aux États-Unis; et mettre en place des mécanismes propres à garantir que les engagements pris au niveau fédéral par les États-Unis seront honorés à tous les niveaux politiques et administratifs;
(xxi) given the huge interest on the part of European companies, notably SMEs, in obtaining non-discriminatory access to public contracts in the US both at federal and sub-federal level, for example for construction services, civil engineering, transport and energy infrastructure and goods and services, to have an ambitious approach to the chapter on public procurement, while respecting the compliance of the chapter with the new EU public procurement and concession directives, with a view to remedying, in line with the principle of reciprocity, the large disparity that currently exists in the degree of openness of the two public procurement markets on both sides of the Atlantic by significantly opening up the US market (still governed by the Buy American Act of 1933) at federal and sub-federal level alike building on commitments made in the Agreement on Government Procurement (GPA) and by removing the restrictions that currently apply at federal, state and local level alike in the United States; and to set up mechanisms to guarantee that commitments entered into by the US federal authorities will be honoured at all political and administrative levels;

‘cartel’ means an agreement or concerted practice between two or more competitors aimed at coordinating their competitive behaviour on the market or influencing the relevant parameters of competition through practices such as, but not limited to, the fixing or coordination of purchase or selling prices or other trading conditions, including in relation to intellectual property rights, the allocation of production or sales quotas, the sharing of markets and customers, including bid-rigging, restrictions of imports or exports or anti-competitive actions against other competitors.

(12) ‘cartel’ means two or more horizontal competitors coordinating their behaviour within a market to earn rents above those possible under normal competition, or coordinating their behaviour within a market to exclude undertakings operating under normal market conditions from gaining market share, through practices such as, inter alia, the fixing or coordination of purchase or selling prices or other trading conditions, abusive licensing practices, the allocation of production or sales quotas, the sharing of markets and customers, including bid-rigging, restrictions of imports or exports [...]or anti-competitive actions against other competitors;

Les provinces et les territoires ont un certain nombre d’accords de commerce internes établissant des règles et procédures semblables dans le domaine des marchés publics. Provinces and territories have a number of internal trade arrangements, which establish similar rules and procedures for the area of government procurement, such as the Agreement on Internal Trade, the New West Partnership agreement between the western provinces, the Atlantic Procurement Agreement and the Trade and Cooperation Agreement Between Ontario and Quebec.
