IN-CONTEXT TRANSLATIONS

1. Lorsqu'elle considère que des dépenses relevant du champ d'application de l'article 4, paragraphe 1, et de l'article 5 n'ont pas été effectuées conformément au droit de l'Union et, pour le Feader, n'ont pas été effectuées conformément au droit de l'Union et de l'État membre applicable visé à l'article 85 du règlement (UE) no 1303/2013, la Commission adopte des actes d'exécution déterminant les montants à exclure du financement de l'Union.
1. Where it finds that expenditure falling within the scope of Article 4(1) and Article 5 has not been effected in conformity with Union law and, in respect of the EAFRD, has not been effected in conformity with the applicable Union and national law referred to in Article 85 of Regulation (EU) No 1303/2013, the Commission shall adopt implementing acts determining the amounts to be excluded from Union financing.

1. Where the declarations of expenditure or the information referred to in Article 102 enable the Commission to establish that expenditure has been effected by bodies which are not accredited paying agencies, that payment periods or financial ceilings set by Union law have not been respected or that expenditure has otherwise not been effected in accordance with Union rules, the Commission may reduce or suspend the monthly or interim payments to the Member State concerned in the framework of the implementing acts concerning the monthly payments referred to in Article 18(3) or in the framework of the interim payments referred to in Article 36, after giving the Member State an opportunity to submit its comments.

annul Commission Implementing Decision of 19 December 2014 on excluding from European Union financing certain expenditure incurred by the Member States under the Guarantee Section of the European Agricultural Guidance and Guarantee Fund (EAGGF), under the European Agricultural Guarantee Fund (EAGF) and under the European Agricultural Fund for Rural Development (EAFRD) [notified under document C(2014) 10135] (OJ 2012 L 369, p. 71), in so far as it excludes from European Union financing expenditure which was incurred in the field of area payments in the 2008 claim year and correspond to: (a) 10 % of the whole amount of expenditure incurred for pasture land payments, (b) 5 % of the whole amount of expenditure incurred for additional coupled payments and (c) 5 % of the whole amount of the expenditure incurred in the area of rural development.

In order to determine the amounts that may be excluded from Union financing, when finding that expenditure has not been incurred in conformity with Union law, and concerning EAFRD, in conformity with the applicable Union and national law, the Commission shall use its own findings and shall take into account the information made available by the Member States during the conformity clearance procedure carried out in accordance with Article 52 of Regulation (EU) No 1306/2013.
