La détermination de la loi objectivement applicable (article 6 2) procède cependant d'un esprit différent de celui l'article 5 : tandis que pour ce dernier, la loi applicable est celle de la résidence habituelle du consommateur - loi que le consommateur connaît en général et sur la protection de laquelle il compte -, l'article 6 2 essaye de déterminer la loi avec laquelle le contrat présente les liens les plus étroits.
But the spirit behind the determination of the objectively applicable law in Article 6(2) is different from Article 5: while for Article 5, the applicable law is that of the consumer's residence, which is the law that the consumer generally knows and on the protection of which he relies, Article 6(2) tries to determine the law with which the contract is most closely connected.

(2) For the purpose of subsection (1), the time spent by officers and employees of the Board on activities directly related to the administration of the Board and on activities indirectly related to the responsibilities of the Board referred to in paragraphs (1)(a), (b) and (c) shall be apportioned among each of the amounts of time referred to in those paragraphs, respectively, in the same proportion as each amount of time is to the total time spent by officers and employees of the Board on activities directly related to those responsibilities.

(2) Subject to subsection (3), the board of directors shall cause notice of any fees, charges or manner that it proposes to fix pursuant to subsection (1) to be published at least thirty days before the proposed effective date thereof in the Canada Gazette and in one or more newspapers of general circulation in the City of Quebec and shall specify in the notice the place to which and the time within which representations may be sent with respect to the proposed fees, charges or manner.

In view of the increasing mobility of citizens and in order to ensure the proper administration of justice within the Union and to ensure that a genuine connecting factor exists between the succession and the Member State in which jurisdiction is exercised, this Regulation should provide that the general connecting factor for the purposes of determining both jurisdiction and the applicable law should be the habitual residence of the deceased at the time of death.
