6. Reiterates its call to the Commission to propose common judicial standards to strengthen integration and cooperation among Member States; calls on the Commission, in particular, on the basis of an evaluation report on the implementation of the Framework Decision on the fight against organised crime and building on Member States' most advanced legislation, to submit, by the end of 2013, a legislative proposal setting out a common definition of organised crime, which should include, inter alia , the offence of participation in a transnational criminal organisation, emphasising the fact that criminal groups of this kind are business oriented, highly organised, technologically sophisticated, and often act through intimidation and blackmail; calls on the Commission, moreover, to take into account Article 2(a) of the UN Convention against Transnational Organised Crime;

BK. whereas the European approach to combating organised crime, corruption, and money laundering must be based on the best available threat assessments and on closer judicial and police cooperation, extending also to non-EU countries, common definitions of criminal offences - including participation in a criminal organisation and self-laundering -, criminalisation of all forms of corruption, approximation of Member States’ legislation concerning certain procedurally relevant arrangements such as statute of limitations, effective systems for the confiscation and recovery of proceeds of organised crime and corruption, increased accountability of government, politicians, lawyers, notaries, real estate agents, insurance companies and other businesses, training of judges and police forces, and the exchange of best practices relating to proper means of prevention;

7. invite la Commission, compte tenu de l'impact extrêmement limité sur les systèmes législatifs des États membres de la décision-cadre 2008/841/JAI sur la criminalité organisée, laquelle n'a pas apporté d'améliorations significatives aux législations nationales ni à la coopération opérationnelle visant à lutter contre la criminalité organisée, à présenter, d'ici à la fin de l'année 2013, une proposition de directive qui contienne une définition de la criminalité organisée plus concrète et qui cerne mieux les caractéristiques essentielles du phénomène, en s'attachant tout particulièrement au concept clé d'organisation et en tenant également mieux compte des nouveaux types de criminalité organisée; demande que, s'agissant de l'infraction consistant à participer à une organisation criminelle, il soit proposé, dans le plein respect des différences et des spécificités des systèmes législatifs nationaux, une étude soit menée concernant l'abolition de la double approche actuelle (qui criminalise aussi bien la participation que la conspiration) et qui définisse une série d'infractions habituellement commises par le crime organisé et pour lesquelles, indépendamment de la peine maximale prévue par le système judiciaire des États membres, une telle incrimination pénale pourrait être envisageable; demande par ailleurs que soient posées plus rigoureusement la question de la criminalisation de toute forme de soutien aux organisations criminelles;
7. Taking account of the extremely limited impact on the legislative systems of the Member States of Framework Decision 2008/841/JHA on organised crime, which has not made any significant improvement to national laws or to operational cooperation to counter organised crime, calls on the Commission to submit, by the end of 2013, a proposal for a directive which contains a more concrete definition of organised crime and better identifies the key features of the phenomenon, focusing in particular on the key concept of organisation and also taking into account new types of organised crime; requests, as regards the offence of membership of a criminal organisation and with due regard to the different and specific characteristics of the various national legal systems, a study of the abolition of the current dual approach (which criminalises both membership and conspiracy) and the identification of a range of typical offences which, regardless of the maximum sentence permitted in the legal system of Member States, could be deemed to constitute such a criminal offence; calls also for more rigorous scrutiny of the question of criminalising all forms of support for criminal organisations;

15. entend créer, dans les trois mois suivant l'adoption de la présente résolution, une commission spéciale sur la propagation des organisations criminelles agissant au niveau international, y compris les mafias, qui aura notamment pour mission d'approfondir la connaissance du phénomène et de ses impacts négatifs sur les plans social et économique à l'échelle de l'Union européenne, et qui se penchera, entre autres, sur la question du détournement des fonds publics de la part des organisations criminelles et des mafias et de leur infiltration dans le secteur public, ainsi que la contamination de l'économie légale et du système financier, ainsi que sur la définition d'une série de mesures législatives permettant de contrer cette menace tangible et reconnue qui pèse sur l'Union européenne et sur ses citoyens; demande donc à la Conférence des présidents de modifier la proposition, conformément à l'article 184 du règlement;
15. Intends to set up, within three months of the adoption of this resolution, a special committee on the dissemination of criminal organisations which operate across borders, including mafias, one of whose aims will be to investigate the extent of the phenomenon and the negative social and economic impact it has throughout the EU, including the issue of the misappropriation of public funds by criminal organisations and mafias and their infiltration into the public sector, as well as the contamination of the legal economy and financial system, while another aim will be to identify a range of legislative measures in order to address this tangible and acknowledged threat to the EU and its citizens; calls, therefore, on the Conference of Presidents to put forward a proposal under Rule 184 of the Rules of Procedure;

The definition of a criminal organization offence in the Criminal Code includes the three special criminal organization offences that have been created in the code, namely: participation in the activities of a criminal organization; committing a crime for the benefit of, at the direction of or in association with a criminal organization; and instructing the commission of an offence for a criminal organization.
