The Commission has decided to send a letter of formal notice to Germany for its failure to implement the judgment delivered by the Court on 19 January 2006 in Case C-244/04 concerning the posting of workers who are nationals of non-EU countries. The Court had found that in not confining itself to making the posting of workers who are nationals of non-EU countries in order to provide services on its territory subject to a simple prior declaration by the undertaking established in another Member State which intends to post such workers, and in requiring the workers to have been employed by this undertaking for at least a year, Germany has failed in its obligations under Article 49 EC.
