12. rappelle que l'UE a elle-même déclaré, tant devant ses citoyens que devant le monde entier, qu'elle était une communauté de valeurs, que les libertés et les droits fondamentaux constituaient le noyau essentiel de cette communauté de valeurs et qu'ils avaient trouvé leur expression la plus complète dans la Charte des droits fondamentaux et avaient été maintes fois reconnus par les institutions de l'UE et par tous les États membres; considère par conséquent comme un dramatique retour en arrière et comme une atteinte grave au sens profond de l'identité de l'Union européenne qu'un ou plusieurs États membres puissent à présent se prévaloir d'une clause d'opting out par rapport à la Charte des droits fondamentaux; demande par conséquent instamment à tous les États membres de mettre à nouveau tout en œuvre pour surmonter cette division interne et revenir à un consensus sur la pleine validité de la Charte;

Recalls that the EU has declared itself, both to its own citizens and to the whole world, to be a community of values, that fundamental rights and freedoms form the innermost core of this community of values and that they have been comprehensively expressed in the Charter of Fundamental Rights and recognised by the EU institutions and all the Member States on many occasions; considers, therefore, that if one or more Member States now claim an opt-out from the Charter of Fundamental Rights, this would represent a dramatic setback and cause serious damage to the EU's innermost sense of identity; for this reason, urgently appeals to all Member States once again to make every effort to overcome this internal division and to reach a consensus after all on the complete validity of the Charter;

As explained in recitals (73) and (74) of Decision 2006/323/EC, the excise duties on mineral oils can be considered as environmental taxes, they must be considered as existing taxes within the meaning of point 51.2 of the guidelines, they have an appreciable positive impact in terms of environmental protection within the meaning of point 51.2(a) and they may be considered as if they had been decided at the time the excise tax was adopted.

(9) Whereas it should be accepted that, for a limited period and after consulting the Commission, Member States may require persons who have never previously obtained a certificate of professional competence in a Member State, but who have passed an examination of professional competence in one Member State when they were normally resident in another Member State where they intend to take up the occupation of road transport operator for the first time, to sit an additional examination; whereas such additional examination must cover areas in which national aspects of the profession differ from those of the Member State where they passed the examination, in particular the specific national commercial, social, fiscal and technical aspects or aspects linked to the organisation of the market and to company law;
