Notes that under the Frontex regulation there appear to be no legal obstacles to the introduction of an individual complaints mechanism and that such a mechanism would even fall within the scope of Article 26a(3) of the Frontex regulation, according to which the Fundamental Rights Officer is to contribute to the mechanism for monitoring fundamental rights; notes that such a mechanism would be compliant with EU law and the principle of good administration and would reinforce the effective implementation of the Agency’s fundamental rights strategy; believes that the capacity of Frontex to deal with possible violations of fundamental rights should be strengthened in the context of expanding its role under EU law, in particular its participation in Migration Management Support Teams working in ‘hotspot’ areas and its operational cooperation with the competent authorities of partner countries through working arrangements;

Urges the Commission to ensure that the abovementioned internal strategy is accompanied by a clear and detailed new mechanism, soundly based on international and European law and embracing all the values protected by Article 2 TEU, in order to ensure coherence with the Strategic Framework on Human Rights and Democracy already applied in EU external relations and render the European institutions and Member States accountable for their actions and omissions with regard to fundamental rights; believes that this mechanism should enable the monitoring of the compliance of all EU Member States with regard to fundamental rights and provide for a systematic and institutionalised dialogue in case of breach of fundamental rights by one or several Member States; considers that in order to make full use of the Treaties' provisions the Commission should:

4. The executive director shall, after consulting the fundamental rights officer and informing the Member State concerned, withdraw the financing of a joint operation, rapid border intervention, pilot project, migration management support team deployment, return operation, return intervention or working arrangement or suspend or terminate, in whole or in part such activities, if he or she considers that there are violations of fundamental rights or international protection obligations that are of a serious nature or are likely to persist.

This proposal safeguards fundamental rights by setting out the need for the European Border and Coast Guard Agency to have a Fundamental Rights Strategy, by establishing a Consultative Forum on fundamental rights, by providing for an expanded role for the Fundamental Rights Officer and by including a complaint mechanism by which any person who considers himself or herself to have been the subject of a breach of fundamental rights during activities carried out by the Agency, or any third party intervener, may make a complaint to the European Border and Coast Guard Agency.

The Commission maintains that, among other things, the very short period between the publication of the legislation and its date of application was not sufficient to give investors the opportunity to adapt to the new legal environment.As a result, the law deprived existing investors of their acquired rights and the value of their investments in a way that did not ensure legal certainty and the respect of the right to property, as enshrined in the EU Charter of Fundamental Rights.The Commission is of the opinion that this violates the principles of free movement of capital and freedom of establishment.
