Il s'agit d'obtenir concrètement de l'Etat membre des garanties minimales de non récidive dans le cas où il n'aurait pas été possible de mettre fin à une infraction, celle-ci ayant déjà été commise au moment où l'Etat membre a décidé de se rallier à la position soutenue par la Commission (par exemple dans le cas où un marché public aurait été passé, l'ouvrage réalisé, alors qu'une autorisation d'importation, contraire au droit communautaire a été exigée et obtenue de l'opérateur) telles que : a) la reconnaissance par l'Etat membre concerné qu'une infraction a été commise; b) l'engagement de l'Etat membre à suivre une politique pro-active de prévention et d'information (en donnant, par exemple, les "instructions" nécessaires aux autorités concernées, en particulier les autorités décentralisées pour que celles-ci interprètent et appliquent correctement une disposition du traité ou du droit dérivé).
Minimum guarantees that it will not re-offend can be obtained from a Member State where it has not been possible to put an end to an infringement as it had already been committed when the Member State decided to come into line with the Commission's argument (e.g. a public contract has already been awarded, the work has been performed, an import licence not required by Community law has been demanded and received from an importer), such as (a) recognition by the Member State concerned that an infringement has been committed; (b) commitment from the Member State to pursuing a proactive prevention and information policy (for example, by giving the necessary "instructions" to the authorities concerned, especially decentralised authorities, so that the latter correctly interpret and apply a provision of the Treaty or of secondary legislation).

4. Le titulaire de l'un des droits visés aux paragraphes 1 ou 2, qui a préalablement demandé la nullité de la marque communautaire ou introduit une demande reconventionnelle dans une action en contrefaçon, ne peut présenter une nouvelle demande en nullité ou introduire une demande reconventionnelle fondée sur un autre de ces droits qu'il aurait pu invoquer à l'appui de la première demande.
4. Where the proprietor of one of the rights referred to in paragraphs 1 or 2 has previously applied for a declaration that a Community trade mark is invalid or made a counterclaim in infringement proceedings, he may not submit a new application for a declaration of invalidity or lodge a counterclaim on the basis of another of the said rights which he could have invoked in support of his first application or counterclaim.

For the Community actions financed under this Decision, Regulation (EC, Euratom) No 2988/95 and Regulation (Euratom, EC) No 2185/96 shall apply to any infringement of a provision of Community law, including infringements of a contractual obligation stipulated on the basis of the Programme, resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by it by an unjustified item of expenditure.

For Community actions financed under this Decision, the notion of irregularity referred to in Article 1(2) of Regulation (EC, Euratom) No 2988/95 shall mean any infringement of a provision of Community law or any breach of a contractual obligation resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by it, by an unjustified item of expenditure.
