(51) In order to ensure uniform conditions for the implementation of this Directive, implementing powers should be conferred on the Commission relating to: the content of the file which shall accompany the request of non-application of one or more TSIs or parts of them, the details, the format and the transmission modalities of that file; the scope and the content of the EC declaration of conformity and suitability for use of interoperability constituents, its format and the details of the information included in it ; the classification of the notified national rules in different groups with the aim of facilitating the compatibility checks between fixed and mobile equipment; the verification procedures for subsystems, including the general principles, the content, procedure and documents related to the ‘EC’ verification procedure, and to the verification procedure in the case of national rules; the templates for the ’EC’ declaration of verification and for the declaration of verification in the case of national rules and templates for documents of the technical file that has to accompany the declaration of verification; the common specifications relating to content, data format, functional and technical architecture, operating mode and rules for data input and consultation for the register of infrastructure.

4. En cas de renouvellement ou de réaménagement de sous-systèmes existants, le demandeur envoie à l'autorité nationale de sécurité (pour les sous systèmes énergie et infrastructure et pour les sous-systèmes contrôle-commande et signalisation au sol qui ne sont pas des installations ERTMS ) ou à l'Agence (pour les installations ERTMS et pour les infrastructures transfrontalières ayant un seul gestionnaire d'infrastructure) un dossier décrivant le projet.
4. In the event of renewal or upgrading of existing subsystems, the applicant shall send a file describing the project to the national safety authority (for energy and infrastructure subsystems and for trackside control-command and signalling subsystems which are not ERTMS ) or the Agency (for ERTMS and for cross-border infrastructures with one single infrastructure manager ).

3. Dans le cas d'un renouvellement ou d'un réaménagement, le gestionnaire de l'infrastructure ou les entreprises ferroviaires introduisent auprès de l'État membre concerné un dossier décrivant le projet.
3. In the event of renewal or upgrading, the infrastructure manager or the railway undertaking shall send the Member State concerned a file describing the project.

La Commission a été priée de présenter des orientations concernant l'octroi d'aides d'État aux ports pour la construction d'infrastructures portuaires, comme elle l'a fait dans d'autres secteurs, mais du fait notamment du peu de jurisprudence en la matière, la Commission préfère continuer à examiner les dossiers au cas par cas, quand les données et particularités de chaque situation déterminent seules l'issue de l'affaire.
The Commission has been requested to issue guidelines on port state aid for the construction of port infrastructures, as it has done in other sectors, but notably due to the lack of case law on this subject, the Commission prefers to carry out case-by-case examinations where the facts and specificities of each case alone determine the outcome.
