TRADUCTIONS EN CONTEXTE

1. Lorsqu'un État membre considère que l'introduction ou la circulation sur son territoire de végétaux, produits végétaux ou autres objets en provenance de certains pays tiers ou de certains autres États membres présente un risque phytosanitaire d'un niveau inacceptable en ce qui concerne l'entrée, l'établissement et la dissémination sur son territoire d'un organisme de quarantaine de l'Union ou d'un organisme nuisible jugé satisfaire aux conditions d'inscription sur la liste des organismes de quarantaine de l'Union, et que ce risque n'est pas atténué comme il se doit par les mesures visées à l'article 17, paragraphes 1 et 2, à l'article 18, paragraphe 1, à l'article 19, paragraphe 1, à l'article 28, paragraphes 1 et 2, à l'article 29, paragraphe 1, à l'article 30, paragraphes 1 et 3, à l'article 40, paragraphes 2 et 3, à l'article 41, paragraphes 2 et 3, à l'article 42, paragraphe 3, à l'article 49, paragraphe 1, et à l'article 53, il informe par écrit la Commission et les autres États membres des mesures de l'Union qu'il souhaiterait voir prendre, en joignant les justifications techniques ou scientifiques correspondantes.
1. Where a Member State considers that the introduction into, or movement within, its territory of plants, plant products or other objects from certain third countries or certain other Member States poses an unacceptable level of pest risk concerning the entry into, and establishment and spread in, its territory of a Union quarantine pest or a pest assessed to fulfil the conditions for inclusion in the list of Union quarantine pests, and that risk is not adequately mitigated by the measures referred to in Article 17(1) and (2), Article 18(1), Article 19(1), Article 28(1) and (2), Article 29(1), Article 30(1) and (3), Article 40(2) and (3), Article 41(2) and (3), Article 42(3), Article 49(1) and Article 53, it shall notify in writing the Commission and the other Member States of the Union measures it would like to be taken, together with the technical or scientific justification for those measures.

Calls on the Commission to consider a range of tools for ensuring such protection against unjustified legal prosecution, economic sanctions and discrimination, while also ensuring the protection of confidentiality and trade secrets; draws attention, in this connection, to the example of the US Dodd-Frank Act, which both remunerates whistleblowers for providing the authorities with original information and protects them from legal prosecution and job loss, bearing in mind that such remuneration should not be a stimulus for publishing business-sensitive information; proposes the creation of an independent European body responsible for collecting this information and carrying out investigations, as well as a pan-European whistleblower common fund, to ensure that whistleblowers receive adequate financial assistance, both funded through a levy on a proportion of the funds recovered or fines imposed; takes the view that protection should also be granted to whistleblowers in case they inform the public after the competent authorities at national or EU level were notified, after no reaction within one month;

36. Considers that a European coordinated network for animal welfare should be set up under the existing Community or Member State institutions, and that its work should be based on the general animal welfare legislation proposed above; considers that such a network should designate one institution as the coordinating body, which should perform the tasks assigned to the ‘central coordination institute’ referred to in the aforementioned Commission communication of 28 October 2009; considers, furthermore, that such a coordinating body should in no way duplicate tasks of the Commission or other agencies, but should become a support tool providing assistance to the Commission, Member States, food chain actors and citizens regarding training and education, best practices, information and consumer communication and assessing and stating its views on future legislative and policy proposals and their impact on animal welfare, assessing animal welfare standards on the basis of the latest available knowledge and coordinating an EU system for testing new techniques;

Un accord écrit entre l’organisme payeur et cette entité doit spécifier la nature de l’information et des pièces justificatives à soumettre à l’organisme payeur ainsi que le délai dans lequel elles doivent être fournies.
A written agreement must be concluded between the agency and that body specifying the nature of the information and the supporting documents to be submitted to the agency and the time limit within which they must be submitted.

D'autre part, au moment d'établir un contact direct avec les pays tiers ou d'autres organismes internationaux, Europol se retrouve les mains liées. En effet, l'article 2 de l'acte du Conseil de 1999 précise que, si les informations renferment des données personnelles, la transmission de l'information entre Europol et un état ou un organisme tiers doit se faire dans le cadre d'un accord entre les deux parties.
Furthermore, Europol labours under significant restrictions when establishing direct contact with third countries or other international organisations: pursuant to Article 2 of the 1999 Council Act, Europol may not forward personal data to a third country or body other than within the framework of an Agreement between the two parties.

Where the operator and his subcontractors are inspected by different inspection bodies or authorities, the declaration referred to in point 3 must include an agreement by the operator on his behalf and that of his subcontractors, that the different inspection bodies or authorities can exchange information on the operations under their inspection and on the way this exchange of information can be implemented.
