Where appropriate, economic cooperation and other forms of cooperation provided for in this Agreement may be supported by technical assistance from the Community, taking into account the Community’s relevant Council Regulation applicable to technical assistance in the Independent States, the agreed priorities in the indicative programme for Community technical assistance to Central Asia and its application in the Republic of Tajikistan and its established coordination and implementation procedures.

9. reconnaît l'importance croissante que revêtent les relations de transport entre l'Inde et l'UE et appelle les dirigeants de l'UE et de l'Inde à prendre d'autres mesures sur la voie du renforcement de la coopération dans le domaine de l'aviation civile, en signant i) l'accord horizontal sur les transports aériens qui rétablira la sécurité juridique dans les accords relatifs aux liaisons aériennes que l'Inde a passés avec vingt‑six États membres de l'UE, ii) un plan d'action commun pour la coopération future dans un large éventail de domaines de l'aviation civile et iii) un important projet de coopération technique UE‑Inde dans le domaine de l'aviation, auquel l'UE contribuera par un financement de 12,5 millions d'euros, dans le prolongement de l'assistance technique fournie dans le passé par l'UE à l'Inde en matière de sécurité aérienne; apporte en outre son soutien à la finalisation des négociations entre l'UE et l'Inde sur un accord bilatéral dans le domaine des transports maritimes dont l'importance sera capitale pour le développement des relations commerciales entre l'UE et l'Inde et pour le renforcement de la coopération en matière de qualité des transports maritimes et de sécurité maritime;

Acknowledges the increasingly important transport links between India and the EU, and calls on the EU and Indian leaders to take further steps towards strengthening cooperation in civil aviation by signing (i) the Horizontal Air Transport Agreement, which will restore legal certainty to the bilateral air services agreements that India has with 26 EU Member States, (ii) a Joint Action Plan for future cooperation in a wide range of areas in the field of civil aviation and (iii) a significant EU-India technical cooperation project in aviation with EU funding of EUR 12.5 million as a follow-up to past EU technical assistance to India in connection with aviation safety; also supports the finalisation of the negotiations between the EU and India on a bilateral maritime transport agreement, which would be of major importance to the development of trade relations between the EU and India and increase cooperation in quality shipping and maritime safety;

Whereas the Council's Legal Service maintains that “Article 181a empowers the Community, within its sphere of competence, to adopt 'economic, financial and technical cooperation measures' with third (non-developing) countries” and “Article 181a was introduced in the TEC by the Treaty of Nice in order to provide a specific legal basis for technical and financial assistance measures outside the Community's development cooperation policy”, the Commission argues that Article 181a is needed in order to allow it to "carry out certain - unspecified - economic cooperation activities with developing countries".

Comme annoncé dans sa communication de décembre (COM(2002) 703), la Commission propose d'établir un programme d'assistance technique et financière dans le domaine de l'asile et des migrations pour les années 2004-2008 avec un montant de référence financière de 250 millions d'euros. Il s'agit d'un programme pluriannuel de coopération avec les pays tiers, dont les actions ciblées s'inscriraient en complément des actions existant dans les mêmes domaines, financées à partir d'autres instruments de coopération et de développement.
2. As announced in the December 2002 communication (COM(2002)703), the Commission is now proposing that a financial and technical assistance programme be established in the area of migration and asylum for the period 2004-2008, with a financial reference amount of EUR 250 m. It would be a multiannual programme for cooperation with third countries with targeted measures complementing existing measures in the same areas which are funded under other cooperation and development instruments.
