4. Pour certaines préparations classées comme dangereuses au sens de l'article 7, par dérogation au paragraphe 3, points d), e) et f) du présent article, la Commission est habilitée à adopter des actes délégués conformément à l’article 20 aux fins de déterminer des exemptions à certaines dispositions d'étiquetage environnemental ou des dispositions particulières en matière d'étiquetage environnemental, s'il peut être démontré qu'il en résulterait une réduction de l'impact sur l'environnement.
4. In relation to certain preparations classified as dangerous within the meaning of Article 7, by way of derogation from points (d), (e) and (f) of paragraph 3 of this Article, the Commission shall be empowered to adopt delegated acts in accordance with Article 20 for the purpose of determining exemptions to certain provisions on environmental labelling or specific provisions in relation to environmental labelling, where it can be demonstrated that there would be a reduction in the environmental impact.

(28) Afin de compléter ou modifier certains éléments non essentiels de la présente directive, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne afin de déterminer des exemptions à certaines dispositions d'étiquetage environnemental, de prendre des mesures dans le cadre des dispositions particulières concernant l'étiquetage de certaines préparations et d'adapter les annexes au progrès technique.
(28) In order to supplement or amend certain non-essential elements of this Directive, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of determining exemptions to certain provisions on environmental labelling, deciding on measures in the framework of the special provisions on the labelling of certain preparations and adapting the Annexes to technical progress.

L'exclusion ne peut donc au plus tôt intervenir qu'après la révision en question. Toutefois, en raison du risque excessif que la mise en œuvre de cette disposition pourrait présenter pour les PME distributrices, la Commission a décidé de suspendre l'exclusion de cette exemption jusqu'à une révision, qui devra intervenir en 2005 et qui déterminera si les conditions prévues à l'article 81, paragraphe 3, nécessitant, pour être satisfaites, l'applicabilité de cette disposition. En outre, pour les fournisseurs de véhicules neufs autres que les voitures particulières, une condition est nécessaire qui limite à cinq ans la durée de la restriction d'établissement d'un distributeur, de manière à permettre aux deux parties d'adapter leurs accords aux changements intervenus sur le marché.
However, because of the excessive risk, which the application of such a provision might produce for small and medium-sized distributors, the Commission decided to suspend this exclusion from the exemption until a review in 2005, which should reveal whether the conditions in article 81, 3 will not be fulfilled unless the provision becomes applicable.Moreover, for suppliers of new motor vehicles other than passenger cars, a condition limiting the duration of restrictions on the place of establishment of a distributor to five years is necessary in order to allow both parties to adapt their agreements to changing market conditions.
