Si les poursuites du gouvernement fédéral n'ont pas été soutenues par le ministère de la Justice, c'est que de la façon dont les opérations ont été faites dans le cadre du comité d'harmonisation qui discutait du dossier Kronos, la compagnie pouvait alléguer qu'ayant reçu une autorisation du gouvernement du Québec dans le cadre de son processus d'autorisation, et les fonctionnaires du gouvernement fédéral siégeant au comité n'ayant pas indiqué clairement à la compagnie que ces conditions-là ne satisfaisaient à ses exigences réglementaires, elle était en droit d'alléguer qu'elle se conformait en même temps aux exigences fédérales.
The reason why the federal government prosecution was not supported by the Department of Justice is because of the way in which things were done by the harmonization committee discussing the Kronos issue; the company could claim that it received authorization from the Quebec government as part of the authorization process and that the federal government officials on the committee did not clearly indicate to the company that these conditions did not comply with its regulatory requirements, therefore the company maintained that it met the federal requirements at the same time.
