Those circumstances are limited to cases where the dispute also involves treatment afforded by the Union, where it appears that the treatment afforded by a Member State is required by Union law and where similar treatment is being challenged in a related claim against the Union in the World Trade Organisation (WTO), where a panel has been established and the claim concerns the same specific legal issue and where it is necessary to ensure a consistent argumentation in the WTO case.

The Commission reached Understandings with Ecuador and the United States of America, on 11 April 2001 and on 30 April 2001 respectively (the ‘Understandings’), which identified means to resolve the disputes brought by those countries in the World Trade Organisation (WTO) with respect to the tariff treatment of bananas imported into the Union.

(3) À la lumière des résultats d'une procédure de règlement des différends engagée devant l'Organisation mondiale du commerce (OMC) par les États-Unis d'Amérique et le Canada (affaire des hormones)(5) et des recommandations formulées par l'organe de règlement des différends de l'OMC le 13 février 1998, la Commission a immédiatement procédé à une évaluation des risques complémentaire, conformément aux dispositions de l'accord sur l'application des mesures sanitaires et phytosanitaires (OMC-GATT 1994)(6), tel qu'il a été interprété par l'organe d'appel dans l'affaire des hormones, de six substances hormonales (oestradiol 17 ß, testostérone, progestérone, acétate de trenbolone, zéranol et acétate de mélengestrol) dont l'administration en vue de stimuler la croissance des animaux est interdite par la directive 96/22/CE.
(3) In the light of the results of a dispute settlement case brought before the World Trade Organisation (WTO) by the United States of America and by Canada (the Hormones case)(5) and recommendations made in that respect by the WTO Dispute Settlement Body on 13 February 1998, the Commission immediately initiated a complementary risk assessment, in accordance with the requirements of the Agreement on the application of sanitary and phytosanitary measures (WTO-GATT)(6) as interpreted by the appellate body in the Hormones case, of the six hormonal substances (oestradiol 17ß, testosterone, progesterone, trenbolone acetate, zeranol and melengestrol acetate) whose administration for animal growth promotion purposes is prohibited by Directive 96/22/EC.
