S'agissant de l'affaire T-11/06,Romana Tabacchi/Commission, dans son arrêt d’aujourd’hui, le Tribunal a considéré que, lors du calcul du montant de l'amende infligée à Romana Tabacchi, la Commission a, d'une part, commis des erreurs d'appréciation des faits en ce qui concerne la durée de la participation de celle-ci à l'entente et, d'autre part, a violé le principe d'égalité de traitement, lors de l'appréciation du poids spécifique de cette participation.
With respect to Case T-11/06 Romana Tabacchi v Commission, in its judgment of today, the Court considers that when calculating the fine imposed on Romana Tabacchi, the Commission erred in its assessment of the facts as regards the duration of Romana Tabacchi’s participation in the cartel and infringed the principle of equal treatment when assessing the specific weight of that participation.

(2) Par l'arrêt rendu par la Cour de justice des Communautés européennes le 7 septembre 2006 dans l'affaire C-310/04, le chapitre 10 bis du titre IV du règlement (CE) n° 1782/2003 a été annulé pour violation du principe de proportionnalité, et notamment en raison du fait que "le Conseil, auteur du règlement (CE) n° 864/2004, n'a pas établi devant la Cour que le nouveau régime d'aide au coton institué par ce règlement a été adopté moyennant un exercice effectif de son pouvoir d'appréciation, lequel impliquait la prise en considération de tous les éléments et circonstances pertinents de l'espèce, parmi lesquels l'ensemble des coûts salariaux liés à la culture du coton et la viabilité des entreprises d'égrenage, dont la prise en compte était nécessaire à l'appréciation de la rentabilité de cette culture" et que la Cour n'a pas été en mesure "de vérifier si le législateur communautaire a pu, sans dépasser les limites du large pouvoir d'appréciation dont il dispose en la matière, arriver à la conclusion que la fixation du montant de l'aide spécifique au coton à 35 % du total des aides existantes dans le régime d'aide antérieur suffit à garantir l'objectif exposé au cinquième considérant du règlement (CE) n° 864/2004, étant d'assurer la rentabilité et, donc, la poursuite de cette culture, objectif qui reflète celui prescrit au paragraphe 2 du protocole n° 4".
(2) By judgement of the Court of Justice of the European Communities of 7 September 2006 in case C-310/04 Chapter 10a of Title IV of Regulation (EC) No 1782/2003 was annulled for breach of the principle of proportionality, in particular with reference to the circumstance that "the Council, the author of Regulation (EC) No 864/2004, [had] not shown before the Court that in adopting the new cotton support scheme established by that regulation it actually exercised its discretion, involving the taking into consideration of all the relevant factors and circumstances of the case, including all the labour costs linked to cotton growing and the viability of the ginning undertakings, which it was necessary to take into account for assessing the profitability of that crop" and that the Court had not been enabled "to ascertain whether the Community legislature [had been] able, without exceeding the bounds of the broad discretion it enjoys in the matter, to reach the conclusion that fixing the amount of the specific aid for cotton at 35% of the total existing aid under the previous support scheme would suffice to guarantee the objective set out in recital 5 in the preamble to Regulation (EC) No 864/2004, namely to ensure the profitability and hence the continuation of that crop, an objective reflecting that laid down in paragraph 2 of Protocol 4 ".
