In the area of European defence procurement, the Commission will present an interpretative Communication of the European Court of Justice's most recent rulings on such matters, as well as a Green Paper on European defence procurement in 2004.

Dans ces hypothèses, le rejet de la réclamation constitue un acte soumis au contrôle du juge, qui le prend en considération dans l’appréciation de la légalité de l’acte contesté, voire le considère comme un acte faisant grief se substituant à ce dernier (arrêt Adjemian e.a./Commission, T‑325/09 P, EU:T:2011:506, point 32).

Pour ce qui est des mesures liées à l’arrêt, j’aimerais obtenir l’assurance de la Commission que celles-ci s’appliqueront à ceux qui souhaitent arrêter leurs activités pendant un court laps de temps pour des raisons économiques, mais aussi que la restriction imposant que ces mesures bénéficient uniquement à ceux qui font partie du programme de restructuration sera interprétée de la manière la plus large possible.

La Commission a ensuite l’intention d’évaluer la mise en œuvre de la directive en tenant compte des derniers arrêts de la Cour de justice européenne, tout en coopérant étroitement avec le Parlement en ce qui concerne la préparation de son rapport d’initiative.
