2. Conformément à l'article 36 du traité d'adhésion et aux conclusions pertinentes du Conseil européen et du Conseil, le Conseil rappelle l'importance qu'il attache à un contrôle strict du respect, par la Croatie, de tous les engagements qu'elle a pris dans le cadre des négociations d'adhésion, notamment ceux qui doivent être remplis avant la date d'adhésion, et de la poursuite par ce pays de ses travaux préparatoires en vue d'assumer pleinement, à la date de l'adhésion, les obligations qui lui incombent.
In line with Article 36 of the Accession Treaty and with relevant European Council and Council conclusions, the Council reiterates the importance it attaches to the close monitoring of Croatia's fulfilment of all the commitments undertaken in the accession negotiations, including those which must be fulfilled before accession, and to Croatia's continued preparations to fully assume its membership obligations upon accession.

2. 2. The prohibition in Article 81(1) of the Treaty shall not apply to agreements, decisions and concerted practices which were in existence at the date of accession of Austria, Finland and Sweden or at the date of accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia and which, by reason of accession, fall within the scope of Article 81(1) of the Treaty if, within six months from the date of accession, they are so amended that they comply with the conditions laid down in Article 3 of this Regulation.

3. 3. Where an application for the registration of a Community trade mark has been filed during the six months prior to the date of accession, notice of opposition may be given pursuant to Article 41 where an earlier trade mark or another earlier right within the meaning of Article 8 was acquired in a new Member State prior to accession, provided that it was acquired in good faith and that the filing date or, where applicable, the priority date or the date of acquisition in the new Member State of the earlier trade mark or other earlier right precedes the filing date or, where applicable, the priority date of the Community trade mark applied for.

(a) were granted before accession but are not applicable after accession - these measures cannot be examined by the Commission either under the procedures laid down in Article 88 EC Treaty or under the Accession Treaty (Annex VI.3) (b) were granted before accession and are applicable after accession - these measures are subject to a lighter assessment under the so-called interim mechanism provided for in Annex IV. 3 of the Accession Treaty and can become “existing aid” if found compatible with the common market or (c) were not granted before accession; these measures constitute new aid and the Commission assesses their compatibility with EC Treaty state aid rules.

Article 3(1) of the Act of Accession states that the provisions of the Schengen acquis and the acts building upon it or otherwise related to it, listed in Annex I to the Act, will be binding on and applicable in the new Member States from the date of accession.[27] Provisions and acts not referred to in the Annex, while binding on the new Member States from the date of accession, will only apply in a new Member State pursuant to a Council decision to that effect taken in accordance with the article (Article 3(2) of the Act of Accession).
