Le règlement des différends entre investisseurs et États (RDIE), tel qu'il figure dans de nombreux accords commerciaux bilatéraux négociés par les gouvernements de l'UE, a été remplacé par un système juridictionnel des investissements amélioré. Ce nouveau mécanisme sera transparent et ne s'appuiera pas sur des tribunaux ad hoc.
The current form of investor-state dispute settlement (ISDS) that exists in many bilateral trade agreements negotiated by EU governments has been replaced with a new and improved Investment Court System. The new mechanism will be transparent and not based on ad hoc tribunals.

Sachant qu'en cas de décision négative de la Commission imposant le recouvrement de l'aide incompatible octroyée à ENVC conformément aux articles 107 et 108 TFUE, la plupart des actifs d'ENVC seront vendus et le processus de liquidation d'ENVC sera quasiment conclu, l'État portugais demande respectueusement à la Commission de confirmer que dans les conditions décrites ci-dessus, la vente desdits actifs ne constitue pas une aide octroyée aux acheteurs.
Taking in consideration that, in the event of a negative Commission decision imposing the recovery of incompatible aid to ENVC in the context of Articles 107 and 108 TFEU, most part of ENVC assets will be sold and the process of ENVC winding up will be practically concluded, the Portuguese State kindly requests the Commission to confirm that under the conditions described above the sale of the said assets does not constitute aid to the purchasers.

Le montant à récupérer était de 76,327 millions d’euros, majoré d’intérêts.
In the Commission's view, that ad hoc State aid granted to the NOS in its capacity as the PO for its public service mission in the Netherlands public service broadcasting system was incompatible with the common market and had to be recovered from the NOS. The amount to be recovered was €76.327 million, plus interest.

However, this condition will not normally apply to small enterprises, since it can be assumed that ad hoc aid to small enterprises does not normally distort competition to an extent contrary to the common interest, except where otherwise provided by rules on State aid in a particular sector or when the beneficiary is active in a market suffering from long-term overcapacity.
