Tout traitement de données à caractère personnel dans le cadre du présent règlement, par exemple l’échange ou la transmission de telles données par les autorités compétentes, devrait être effectué conformément au règlement (UE) 2016/679, et tout échange ou transmission d’informations par l’AEMF devrait être effectué conformément au règlement (CE) no 45/2001.
Any processing of personal data carried out within the framework of this Regulation, such as the exchange or transmission of personal data by the competent authorities, should be undertaken in accordance with Regulation (EU) 2016/679 and any exchange or transmission of information by ESMA should be undertaken in accordance with Regulation (EC) No 45/2001.

Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

(5) Afin que l'efficacité de ces échanges ne soit pas amoindrie, la possibilité que la transmission d'informations puisse être refusée dans le cas où elle conduirait à divulguer un secret commercial, industriel ou professionnel ou un procédé commercial, ou une information dont la divulgation serait contraire à l'ordre public ne devrait pas s'appliquer aux dispositions concernant l'échange automatique et obligatoire d'informations sur les décisions fiscales anticipées en matière transfrontière et les accords préalables en matière de prix de transfert.
(5) The possibility that the provision of information may be refused where it would lead to the disclosure of a commercial, industrial or professional secret or of a commercial process, or of information whose disclosure would be contrary to public policy should not apply to provisions of mandatory automatic exchange of information on advance cross-border rulings and advance pricing arrangements in order not to reduce the effectiveness of these exchanges.

Le soutien financier dans ces domaines devrait surtout s’appliquer à des actions qui favorisent les opérations transfrontières conjointes, l’échange d’informations et l’accès à ces informations, l’échange des meilleures pratiques, la facilitation et la sécurisation de la communication et de la coordination, la formation et les échanges de personnel, les activités d’analyse, de suivi et d’évaluation, les évaluations exhaustives des menaces et des risques conformément aux compétences énoncées dans le traité sur le fonctionnement de l’Union européenne, les activités de sensibilisation, l’essai et la validation de nouvelles technologies, la recherche en matière de police technique et scientifique, l’acquisition d’équipements techniques interopérables et la coopération entre les États membres et les organes de l’Union concernés, notamment Europol.
Financial assistance in these areas should in particular support actions promoting cross-border joint operations, access to and exchange of information, exchange of best practices, facilitated and secure communication and coordination, training and exchange of staff, analytical, monitoring and evaluation activities, comprehensive threat and risk assessments in accordance with the competencies set out in the TFEU, awareness raising activities, testing and validation of new technology, forensic science research, the acquisition of technical interoperable equipment and cooperation between Member States and relevant Union bodies, including Europol.

Dans cette optique, la Commission devrait réaliser une étude sur la faisabilité, le coût et les avantages d'une plateforme électronique européenne d'information sur les véhicules et devrait étudier la possibilité d'étendre les fonctions des systèmes d'échanges d'informations en place afin d'inclure les échanges des relevés des compteurs kilométriques dans cette plateforme. Elle devrait aussi explorer la possibilité d'approfondir ces échanges d'informations.
The Commission should therefore carry out a study on the feasibility, costs and benefits of setting-up a European electronic vehicle information platform as well as the possibilities of broadening the functionality of existing information exchange systems, with purpose to include in the platform sharing of odometer readings and to explore the possibilities to broaden information sharing even further.

La décision 2009/739/CE de la Commission du 2 octobre 2009 établissant les modalités pratiques des échanges d'informations par voie électronique entre les États membres prévus au chapitre VI de la directive 2006/123/CE du Parlement européen et du Conseil relative aux services dans le marché intérieur devrait continuer à s'appliquer aux questions relatives aux échanges d'informations dans le cadre de la directive 2006/123/CE.
Commission Decision 2009/739/EC of 2 October 2009 setting out the practical arrangements for the exchange of information by electronic means between the Member States under Chapter VI of Directive 2006/123/EC of the European Parliament and of the Council on services in the internal market should continue to apply to issues relating to the exchange of information under Directive 2006/123/EC.

La présente décision ne devrait nullement empêcher les États membres d’échanger, dans le cadre du réseau européen d’information sur les drogues et les toxicomanies (Reitox), des informations sur les tendances émergentes en matière de nouvelles utilisations des substances psychoactives existantes susceptibles de représenter un danger pour la santé publique, ainsi que des informations sur les mesures de santé publique qui pourraient être prises, conformément au mandat et aux procédures de l’OEDT.
Nothing in this Decision should prevent Member States from exchanging information, within the European Information Network on Drugs and Drug Addiction (hereinafter ‘the Reitox network’), on emerging trends in new uses of existing psychoactive substances which may pose a potential risk to public health, as well as information on possible public health related measures, in accordance with the mandate and procedures of the EMCDDA.

Considers that the Authority should work in close cooperation with national food safety agencies and institutions in the field of food safety so as to build upon, and where appropriate coordinate, their expertise and ensure that information on food safety is communicated to consumers in a clear and comprehensible format: further considers that there should be a two-way exchange of views and information with centres of excellence in all relevant disciplines across the European Union and that this should be coordinated by the EFSA; believes that the EFSA should use the experience of the EEA and its network of focal points and thematic centres;
