[English] Mr. Jason Kenney: Madam Speaker, following consultations that I have had with all of the parties, I rise to seek unanimous consent for the House to adopt the following motion, that in the opinion of this House the government should endorse the formation of an international criminal tribunal for the purpose of prosecuting Saddam Hussein and all other Iraqi officials who are responsible for crimes against humanity, including unlawful use of force, crimes committed in contravention of the Geneva convention, and the crime of genocide (1210) Hon. Don Boudria: Madam Speaker, I am sure this is well intentioned, but I had not been made aware of this until shortly before question period.

invites the Council to pursue without delay, within the appropriate UN structures, the procedures envisaged for a mechanism for dealing with the immediate and longer-term residual functions, concerning for example witness protection, protection from witness intimidation, contempt of court issues, reviews in the event of exculpatory evidence being received, monitoring of trials referred to the region (currently monitored by the Tribunal's Prosecution Service through the Organisation for Security and Co-operation in Europe (OSCE)), conditions of imprisonment and issues relating to pardon or commutation of sentences, etc; suggests that a proposal be put to the UN Security Council for the possible setting-up of a joint office to deal with the future residual functions of the Tribunal and of the International Criminal Tribunal for Rwanda and the Special Court for Sierra Leone;

Nous avons la possibilité de choisir ce que veut l’Union européenne, de choisir si elle veut une guerre ou pas, si elle veut que Saddam quitte l'Irak - car, quoiqu’en dise M. We have the chance to choose what the European Union wants, to choose whether it wants war or not, whether it wants Saddam Hussein to leave Iraq – for, whatever Mr Watson may say, he will leave accompanied, he will essentially have safe conduct as far as his place of exile, and, moreover, I would advise Mr Watson to read the Treaty establishing the International Criminal Court, from which he will learn that, in any case, Saddam Hussein cannot be prosecuted in this situation – but what we can and must do is realise that the UN and the Security Council have a duty to act.

Fifth, we need to take the lead, and we are well positioned by our commitment to international justice to do so, to establish an international criminal tribunal for Iraq, the same way we did with respect to an international criminal tribunal for former Yugoslavia and Rwanda, so that we can bring Saddam Hussein and his co-conspirators to justice.
