L'intervention au titre du présent règlement devrait viser à la création de synergies et à garantir l'interopérabilité entre les différents projets d'intérêt commun décrits à l'annexe, ainsi qu'avec d'autres infrastructures, y compris les infrastructures de transport et d'énergie soutenues par le MIE, les infrastructures de recherche pertinentes soutenues notamment par Horizon 2020 et les infrastructures pertinentes soutenues par les Fonds ESI, tout en évitant les doubles emplois et les coûts administratifs inutiles.
Intervention under this Regulation should aim at achieving synergies and interoperability between the different projects of common interest described in the Annex, as well as with other infrastructures, including transport and energy infrastructures supported by the CEF, relevant research infrastructures supported, inter alia, by Horizon 2020 and relevant infrastructures supported by ESI Funds, while avoiding duplication and undue administrative burdens.

Outre les contreparties décrites aux points 38 à 42, la Commission peut imposer les conditions et obligations qu'elle juge nécessaires pour que la concurrence ne soit pas faussée dans une mesure contraire à l'intérêt commun, au cas où l'État membre concerné ne se serait pas engagé à prendre de telles dispositions.
In addition to the compensatory measures described in points 38 to 42, the Commission may impose any conditions and obligations it considers necessary in order to ensure that the aid does not distort competition to an extent contrary to the common interest, in the event that the Member State concerned has not given a commitment that it will adopt such provisions.

Hence, no other specific compatibility clause seems to be applicable to the notified schemes as currently specified apart from the always possible general application of Article 87(3)(c) of the EC Treaty. The latter provides that, ‘aid to facilitate the development of certain economic activities or of certain economic areas, where such aid does not adversely affect trading conditions to an extent contrary to the common interest, may be considered to be compatible with the common market’.

En l’espèce, compte tenu des mesures décrites précédemment, la seule dérogation qui puisse être invoquée est celle de l’article 87, paragraphe 3, point c), du traité, qui indique que peuvent être considérées comme compatibles avec le marché commun les aides destinées à faciliter le développement de certaines activités ou de certaines régions économiques, quand elles n’altèrent pas les conditions des échanges dans une mesure contraire à l’intérêt commun.
Taking account of the measures described above, the only possible derogation in the matter at hand is that laid down in Article 87(3)(c) of the Treaty, according to which aid may be considered compatible with the common market if it is found to facilitate the development of certain economic activities or of certain economic areas, where such aid does not adversely affect trading conditions to an extent contrary to the common interest.
