2. Le présent protocole additionnel entre en vigueur pour un État ou une organisation régionale d'intégration économique qui le ratifie, l'accepte, l'approuve ou y adhère après le dépôt du quarantième instrument mentionné au paragraphe 1 ci-dessus, soit le quatre-vingt-dixième jour après la date de dépôt par cet État ou par cette organisation régionale d'intégration économique de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion, ou à la date à laquelle le protocole entre en vigueur pour cet État ou pour cette organisation régionale d'intégration économique, la date la plus tardive étant retenue.
2. This Supplementary Protocol shall enter into force for a State or regional economic integration organization that ratifies, accepts or approves it or accedes thereto after the deposit of the fortieth instrument as referred to in paragraph 1 above, on the ninetieth day after the date on which that State or regional economic integration organization deposits its instrument of ratification, acceptance, approval, or accession, or on the date on which the Protocol enters into force for that State or regional economic integration organization, whichever shall be the later.

2. This Protocol shall enter into force for a State or regional economic integration organization that ratifies, accepts or approves this Protocol or accedes thereto after the deposit of the fiftieth instrument as referred to in paragraph 1 above, on the ninetieth day after the date on which that State or regional economic integration organization deposits its instrument of ratification, acceptance, approval or accession, or on the date on which the Convention enters into force for that State or regional economic integration organization, whichever shall be the later.

With regard to those organisations, Article 25(2) provides that ‘[a]ny regional economic integration organisation that becomes a Party to [the] Convention without any of its member States being a Party shall be bound by all the obligations under the Convention’.

However in two countries there exist some doubts regarding the model of economic integration that should be followed (Costa Rica) and whether economic integration should be pursued at all (Panama, which has not yet confirmed its interest in joining the customs union, due to its highly service-oriented economy).

2. Tout État, ou toute organisation d'intégration économique régionale peut, en déposant son instrument de ratification d'acceptation, d'approbation ou d'adhésion, faire une réserve spéciale à l'égard de la mention soit dans l'annexe I, soit dans l'annexe II, soit encore dans les annexes I et II, de toute espèce migratrice. Il ne sera pas considéré comme partie à l'égard de l'objet de ladite mention jusqu'à l'expiration d'un délai de quatre-vingt dix jours à partir de la date à laquelle le dépositaire aura notifié aux parties le retrait de cette réserve.
2. Any State or any regional economic integration organization may, on depositing its instrument of ratification, acceptance, approval or accession, enter a specific reservation with regard to the presence on either Appendix I or Appendix II or both, of any migratory species and shall then not be regarded as a Party in regard to the subject of that reservation until ninety days after the Depositary has transmitted to the Parties notification that such reservation has been withdrawn.
