Les États membres qui procèdent à une inspection en application du paragraphe 1 en informent sans délai le Comité des sanctions, notamment en lui présentant un rapport d'inspection donnant toutes les précisions utiles, en particulier un exposé des motifs de l'inspection et ses résultats, indiquant si possible le pavillon du navire, le nom du navire, le nom du capitaine du navire et d'autres informations relatives à son identité, le nom du propriétaire du navire et celui du vendeur initial de la cargaison, et expliquant quelles démarches ont été faites pour obtenir le consentement de l'État du pavillon du navire.
5. Member States shall promptly notify to the Sanctions Committee any inspections as referred to in paragraph 1, including by submitting a report on the inspection containing all relevant details, including an explanation of the grounds for, and the results of, the inspection and where possible including the flag of the vessel, the name of the vessel, the name and identifying information of the master of the vessel, the owner of the vessel, and the original seller of the cargo, and efforts made to seek the consent of the vessel's flag State.

3. (9) Afin de permettre à la Commission d'actualiser rapidement les procédures afférentes et de contribuer ainsi à la mise en place de conditions de concurrence équitables au niveau mondial pour le transport maritime, le pouvoir d'adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l'Union européenne devrait lui être délégué en ce qui concerne les modifications à apporter à l’annexe VI de la directive 2009/16/CE contenant la liste des "instructions" adoptées dans le mémorandum d'entente de Paris, afin que les procédures applicables et exécutoires sur le territoire des États membres restent conformes aux procédures convenues au niveau international et tiennent compte des directives de l'OIT pour les agents chargés du contrôle par l'État du port effectuant des inspections en application de la convention.
(9) In order to allow the Commission to update the relevant procedures swiftly, thereby contributing to the achievement of a global level playing field for shipping, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of amendments to Annex VI to Directive 2009/16/EC containing the list of the ‘Instructions’ adopted by the Paris MOU, with a view to keeping the procedures applicable and enforceable in the territory of the Member States, in line with those agreed upon at international level and taking into account the ILO Guidelines for port State control officers carrying out inspections under the Convention.

Highlights the lack of emphasis, in existing social security and employment directives, on improved implementation and on the role of labour inspectorates; considers that the existing directives need to be thoroughly reviewed and revised, where necessary, and that the matter of enforcement must be addressed in a better way in European labour law; welcomes, in this context, the Commission’s proposed minimum standards of inspection in directives relating to certain groups of workers; stresses that the role of labour inspectorates, and of the social partners, needs to be taken into account in social security- and employment-related matters in such a way as to permit effective protection;

Calls on the Commission to increase its capacity to process and investigate effectively complaints and infringements connected with the proper implementation of the Birds and Habitats Directives, and to develop adequate guidance for the Member States with regard to monitoring on-the-ground implementation of those directives; calls on the Commission, furthermore, to incorporate measures to enhance the implementation and joint enforcement of the Birds and Habitats Directives into its current work on improving the implementation and inspection of environmental legislation; considers it essential, in the light of its resolution of 20 November 2008 on the review of Recommendation 2001/331/EC providing for minimum criteria for environmental inspections in the Member States , to strengthen the EU Network for the Implementation and Enforcement of Environmental Law (IMPEL), and urges the Commission to report on possible ways of doing so, including the feasibility of establishing an EU environmental inspection force, and to present a proposal for a directive on environmental inspections;

(20b) With a view to increasing effectiveness of inspections for the purpose of application of this Directive, Member States should ensure that: national legislation gives adequate powers to competent authorities to make the inspections; information about illegal employment, including the results of previous inspections, is collected and processed for effective implementation of this Directive; and sufficient staff are available with the skills and qualifications needed to carry out effectively the inspections.

En vue d’une efficacité croissante des inspections aux fins de l’application de la présente directive, les États membres devraient veiller à ce que la législation nationale donne des pouvoirs adéquats aux autorités compétentes pour procéder aux inspections, que les informations concernant l’emploi illégal, y compris les résultats des inspections antérieures, soient collectées et traitées en vue d’une application efficace de la présente directive, et que suffisamment de personnel doté des compétences et des qualifications nécessaires soit disponible pour effectuer efficacement les inspections.

(c) The Committee shall meet periodically at a lower level to discuss, in particular and to the extent necessary, for individual facilities, the operation of the coordination arrangements provided for in this Protocol, including, in the light of technical and operational developments, up-dating of agreed estimates of inspection efforts with respect to changes in throughput, inventory and facility operational programmes, and the application of inspection procedures in different types of routine inspection activities and, in general terms, statistical sampling requirements.
