In response to the changing challenges, the Union has updated its priorities for network and information security policy in a number of documents, including the 2006 Commission Communication A strategy for a Secure Information Society — Dialogue, partnership and empowerment, the Council Resolution of 2007 on a Strategy for a Secure Information Society in Europe, the 2009 Communication Critical Information Infrastructure Protection – ‘Protecting Europe from large scale cyber-attacks and disruptions: enhancing preparedness, security and resilience’, the 2009 Presidency Conclusions of the Ministerial Conference on Critical Information Infrastructure Protection (CIIP) in Tallinn, the Council Resolution of 2009 on a collaborative European approach to Network and Information Security, the 2011 Presidency Statement following the Ministerial Conference on CIIP in Balatonfüred and the 2011 Council conclusions on Critical Information Infrastructure Protection "Achievements and next steps: towards global cyber-security".

The aid beneficiary is obliged to provide entitled third parties with comprehensive and non-discriminatory access to information on its infrastructure (including, inter alia, ducts, street cabinets and fibre) deployed under a State aid measure (115). This will enable other operators to easily ascertain the possibility to access such infrastructure and should provide all relevant information about the broadband network to a central register of broadband infrastructures, if such database exists within the Member State, and/or to the NRA.

15. Supports ENISA, in line with the Digital Agenda goals, in exercising its duties with regard to network information security, and in particular by providing guidance and advising Member States on how to meet baseline capabilities for their CERTs, as well as supporting the exchange of best practices by developing an environment of trust; calls on the agency to consult relevant stakeholders with a view to defining similar cyber-security measures for owners and operators of private networks and infrastructure, as well as to assist the Commission and Member States in contributing to the development and uptake of information security certification schemes, norms of behaviour and cooperation practices among national and European CERTs and owners and operators of infrastructure as and where needed through the definition of technologically neutral common minimum requirements;

The issue of increasing the safety and the resilience of ICT infrastructures was further tackled with increased intensity in the Digital Agenda for Europe and the related Council conclusions, the proposed Directive on attacks against information systems, as well as the Commission’s proposal for a new mandate for a strengthened and modernised ENISA.

It is true that Council Directive 92/44/EEC of 5 June 1992 on the application of open network provision to leased lines, amended by Commission Decision 94/439/EC (8), harmonizes the basic principles regarding the provision of leased lines, but it only harmonizes the conditions of access and use of leased lines. The aim of that Directive is not to remedy the conflict of interest of the telecommunications organizations as infrastructure and service providers. It does not impose a structural separation between the telecommunications organizations as providers of leased lines and as service providers. Complaints illustrate that even in Member States which have implemented that Directive, telecommunications organizations still use their control of the access conditions to the network at the expense of their competitors in the services market. Complaints show that telecommunications organizations still apply excessive tariffs and that they use information acquired as infrastructure providers regarding the services planned by their competitors, to target clients in the services market. Directive 92/44/EEC only provides for the principle of cost-orientation and does not prevent telecommunications organizations to use the information acquired as capacity provider as regards subscribers' usage patterns, necessary to target specific groups of users, and on price elasticities of demand in each service market segment and region of the country. The current regulatory framework does not resolve the conflict of interest mentioned above. The most appropriate remedy to this conflict of interest is therefore to allow service providers to use own or third party telecommunications infrastructure to provide their services to the final customers instead of the infrastructure of their main competitor. In its resolution of 22 December 1994 the Council also approved the principle that infrastructure provision should be liberalized.
