TRADUCTIONS EN CONTEXTE

29. rappelle qu'il existe dans de nombreux États membres, tels que la Suède, la République tchèque, les Pays-Bas, le Royaume-Uni et l'Allemagne, des organismes indépendants qui accompagnent de manière constructive les gouvernements dans le processus législatif afin de réduire les charges administratives qui pèsent sur les entreprises et les citoyens, ainsi que de réduire les coûts liés à l'obligation d'information, d'une façon à la fois mesurable et vérifiable; observe que les bonnes pratiques et l'expérience des organes existants en matière d'amélioration de la réglementation pourraient être prises en compte; prend acte de la transformation du comité d'analyse d'impact en comité indépendant de contrôle réglementaire et escompte que l'inclusion d'experts indépendants aura un effet positif sur le processus d'analyse d'impact de la Commission; insiste toutefois sur le fait que le comité de contrôle réglementaire a un rôle exclusivement consultatif et ne doit pas émettre de positions contraignantes; insiste sur le fait que les analyses d'impact doivent être conformes et doivent par conséquent tenir compte de toute modification introduite lors de la phase de consultation interservices et devraient s'appuyer, entre autres éléments, sur l'estimation des coûts additionnels que les États membres auraient à supporter en l'absence de solution au niveau européen; estime que l'avis du comité de contrôle réglementaire devrait être joint à la proposition législative finale; propose de débattre, dans le cadre de la renégociation à venir de l'accord interinstitutionnel, de la question de savoir s'il serait dans l'intérêt commun des institutions d'instituer un Conseil de contrôle des normes jouant un rôle purement consultatif;
29. Points out that in many Member States, such as Sweden, the Czech Republic, the Netherlands, the United Kingdom and Germany, independent bodies provide governments with constructive input in connection with legislative processes, with the aim of cutting red tape for business and citizens and of measurably and verifiably reducing costs related to obligations to provide information; notes that the best practices and experience of existing better regulation bodies could be taken into account; takes note of the conversion of the Commission’s Impact Assessment Board (IAB) into an independent ‘Regulatory Scrutiny Board’ (RSB) and expects that the inclusion of independent experts will have an advantageous effect on the impact assessment process within the Commission; insists that the Regulatory Scrutiny Board has only an exclusively advisory role and must not issue binding opinions; insist that impact assessments must be consistent and take any changes introduced at the inter-service consultation phase into consideration and should be based inter alia on estimating what the additional costs would be for the Member States if there were no solution at European level; considers that the opinion of the RSB should accompany the final legislative proposal; proposes to discuss in the forthcoming negotiation on the interinstitutional agreement the idea whether a Regulatory Control Council might be of common interest for the institutions as a purely advisory body;

14. Considers that the methodology for the IAB’s impact assessment process should be regularly evaluated by an independent body such as the Court of Auditors; urges that ex-post evaluations be carried out to show whether the policy has been effective and to optimise the methodology for IAs;

12. invite la Commission à mettre en place un comité d'analyse d'impact véritablement indépendant destiné à fournir un aperçu externe critique des études d'impact; suggère que ce comité soit composé de membres indépendants extérieurs à la structure institutionnelle de l'Union européenne, approuvés par le Parlement et le Conseil et assistés par un secrétariat constitué de membres du personnel de la Commission; suggère que ce comité d'analyse d'impact recommande au Parlement de rejeter toute proposition législative si l'étude d'impact qui la concerne ne répond pas aux normes requises;
12. Calls on the Commission to establish a truly independent Impact Assessment Board (IAB) to provide external critical oversight of IAs; suggests that this should be composed of independent members from outside the institutional structure of the EU, approved by the Parliament and Council and supported by a secretariat of Commission staff; suggests that the IAB should recommend to the Parliament to reject a legislative proposal if its accompanying IA does not meet the required standards;

29. souligne que les membres du comité d'analyses d'impact n'ont qu'une indépendance formelle, puisqu'ils sont actuellement nommés par le président de la Commission, qu'ils reçoivent ses instructions et qu'il ne peut donc être question d'une indépendance totale; demande donc que la désignation des membres de ce comité soient soumise à un examen minutieux du Parlement et du Conseil; demande que soit levé son lien de subordination vis-à-vis du président de la Commission; recommande que le comité d'analyses d'impact et les experts aient un mandat public et œuvrent dans la plus grande transparence afin que leur indépendance puisse être vérifiée concrètement;
29. Stresses that the members of the IAB are independent only in formal terms, since they are currently appointed by and subject to the instructions of the Commission President, and cannot therefore be said to be fully independent; calls, therefore, for the members of the IAB to be scrutinized by the European Parliament and the Council prior to appointment and no longer be subject to the instructions of the Commission President; calls for the work of the IAB and experts to take place in the public remit with the highest transparency so that their independence can be verified in practice;

22. souligne que la qualité des analyses d'impact doit être soumise à un contrôle permanent; se félicite de l'avis du comité d'analyses d'impact concernant l'amélioration générale de leur qualité; prend note du fait que le comité applique des critères d'évaluation plus précis; estime pourtant que le taux élevé d'analyses d'impact rejetées d'emblée par le comité (plus de 30 %) montre que les services compétents de la Commission doivent continuer à améliorer la qualité des analyses; demande par ailleurs l'augmentation des ressources humaines dont dispose ce comité;
22. Emphasises that the quality of impact assessments should be subject to continuous monitoring; welcomes the opinion of the Impact Assessment Board on the general improvement in their quality; notes that the Board is applying stricter assessment criteria; notes, at the same time, that the high percentage of impact assessments (over 30%) that are initially rejected by the Board testifies to the need for the relevant Commission departments to improve their quality further; calls for an increase in the staff available to the Board;
