The national emission reduction plan shall reduce the total annual emissions of nitrogen oxides (NOx), sulphur dioxide (SO2) and dust from existing plants to the levels that would have been achieved by applying the emission limit values referred to in paragraph 3 to the existing plants in operation in the year 2000, (including those existing plants undergoing a rehabilitation plan in 2000, approved by the competent authority, to meet emission reductions required by national legislation) on the basis of each plant's actual annual operating time, fuel used and thermal input, averaged over the last five years of operation up to and including 2000.

Member States shall ensure that the national emission reduction plan shall reduce the total annual emissions of NOx, SO2 and dust from existing plants to the levels that would have been achieved by applying the emission limit values mentioned in the above indent to the existing plants in operation in the year 2000 or those undergoing a rehabilitation plan in 2000 approved by the competent authority to meet emission reduction requested by national legislation, on the basis of their actual annual operating time, fuel used and thermal input, averaged over the last five years of operation up to and including 2000.

L'accord donné par la Commission est donc soumis au respect des conditions suivantes par le gouvernement portugais : - les deuxième, troisième et quatrième tranches ne seront versées à TAP que si elle réalise le résultat d'exploitation prévu. - l'exonération fiscale accordée à TAP sera abolie à la fin de la période de restructuration; - TAP ne portera pas son offre sur le marché européen à un niveau supérieur à celui indiqué à la Commission, niveau réajustable sur une base annuelle au cas où la croissance réelle du marché de l'EEE en cause serait inférieure à la croissance de TAP; - TAP présentera à la Commission un rapport annuel sur la restructuration quatre semaines avant la date à laquelle les versements doivent être effectués.
The authorisation granted by the Commission is therefore subject to the respect by the Portuguese Government of the following conditions: - the payment of the second, third and four tranche is subject to TAP achieving the forecast operating results; - the tax exemption in favour of TAP will be abolished by the end of the restructuring period; - TAP will not increase its supply on the European market beyond the figures provided to the Commission, which will be readjusted on an annual basis, in case the real growth of the EEA market is lower than TAP's growth; - the Portuguese Governement will submit an annual report on the restructuring to the Commission four weeks before the date of the payments.
