(Return tabled) Question No. 1127 Ms. Chris Charlton: With regard to Labour Market Opinions issued by Human Resources and Skills Development Canada: (a) for the Labour Market Opinions applied for since January 1, 2011, broken down by month, what is (i) the total number of applications, (ii) the number of applications approved, (iii) the number of applications denied, (iv) the average length of time between the receipt of an application and the issuance of the decision; (b) for the Accelerated Labour Market Opinions applied for since the program began, broken down by month, what is (i) the total number of applications, (ii) the number of applications approved, (iii) the number of applications denied, (iv) the average length of time between the receipt of an application and the issuance of the decision, (v) the number of decisions issued later than ten days after receipt of the application; (c) since April 2011, broken down by month, region and industry, how many companies have been found in non-compliance with their Labour Market Opinion, which companies were they, what were the violations and what restitutions did they make for their non-compliance; and (d) since April 2011, broken down by month, region and industry, how many companies have been found in non-compliance with their Accelerated Labour Market Opinion, which companies were they, what were the violations and what restitutions did they make for their non-compliance?

1. Contracting entities which have awarded a contract or a framework agreement shall, within two months of the award of the contract or framework agreement, send a contract award notice as referred to in Annex XVI under conditions to be laid down by the Commission in accordance with the procedure referred to in Article 68(2).

Plus précisément, les principales modifications apportées à la proposition révisée sont les suivantes: Objectif (1) préciser que la proposition en discussion n'ouvrira pas davantage le marché européen aux entreprises des pays tiers (champ d'application de la directive), notamment en: clarifiant le champ d'application de l'AMP et des directives et préciser le régime juridique applicable aux entreprises de pays tiers Objectif (2) remanier le texte en ce qui concerne le dialogue technique de façon à l'assouplir, notamment en: remplaçant l'ancienne disposition sur le "dialogue technique" par un considérant; limitant l'application des modifications des seuils aux marchés et aux secteurs relevant de l'AMP; Objectif (3) réexaminer un certain nombre de modifications de façon à s'en tenir autant que possible aux secteurs visés par l'AMP, notamment en: limitant l'obligation de communiquer aux candidats ou soumissionnaires écartés les motifs de leur rejet, et aux soumissionnaires écartés les caractéristiques et avantages relatifs de l'offre retenue pour les secteurs relevant de l'AMP; limitant les modifications aux modèles d'avis de marchés, et en particulier, à l'avis concernant le système de qualification (annexe XIII) et à l'avis périodique informatif (annexe XIV) à ce qui est expressément requis par l'AMP, comme c'est le cas des informations à fournir par les entités adjudicatrices lorsqu'elles invitent les candidats à confirmer leur intérêt lorsque l'appel d'offres a été lancé au moyen d'un avis périodique indicatif; et prévoyant l'obligation pour la Commission de respecter la nature confidentielle sur le plan commercial des informations communiquées par les entités adjudicatrices dans les avis sur les marchés passés, notamment en ce qui concerne les prix.
More precisely, the principal amendments introduced in the revised proposal consist of: Objective (1) making it clear that the proposal under discussion will not open up the EU market any further to suppliers from third countries (scope of the measure), notably by: clarifying the fields of application of the GPA and the Directives, as well as a clear statement as to the legal regime applicable to third country suppliers Objective (2) rewording the text concerning the technical dialogue in order to make it more flexible, notably by: replacing the earlier provision on "technical dialogue" by a recital and Objective (3) re-examining a number of amendments in order to remain as far as possible within the sectors covered by the GPA, notably by: limiting to the sectors covered by the GPA the obligation to inform eliminated candidates or tenderers of the reasons for their rejection and eliminated tenderers of the characteristics and advantages of the tender selected limiting the application of the changes in the thresholds to the contracts and sectors subject to the GPA limiting the amendments to the model notices, and in particular the notice on the existence of a qualification system (Annex XIII) and the periodic information notice (Annex XIV), to what is explicitly required by the GPA as is the case regarding the information to be provided by contracting entities when they invite candidates to confirm their interest following publication of a periodic indicative notice used as a means of calling for competition and introducing an obligation on the Commission to respect the commercially-sensitive nature of information communicated by contracting entities in notices on contracts awarded and concerning prices.
