Irwin Cotler: With regard to bijuralism and harmonization: (a) what measures are in place to ensure legislative bijuralism across all departments; (b) since the adoption of the “Policy on Legislative Bijuralism”, how has the Department of Justice (i) ensured that all legal counsel in the Department are made aware of the requirements of legislative bijuralism in order for them to be able to take it into account when advising client departments on legislative reforms, (ii) enhanced the capacity of the Legislative Services Branch to draft bijural legislative texts, (iii) undertook, in drafting both versions of every bill and proposed regulation that touches on provincial or territorial private law, to take care to reflect the terminology, concepts, notions and institutions of both of Canada’s private law systems; (c) since the adoption of the “Policy for Applying the Civil Code of Quebec to Federal Government Activities”, what measures are in place to ensure (i) changes to Quebec’s Civil Code are known and monitored by the government, (ii) assessment of federal legislation relative to changes to Quebec’s Civil Code, (iii) federal legislation is introduced to reflect, where necessary, changes to the Civil Code of Quebec; (d) with respect to the “Index of Bijuralism and Harmonization Caselaw” found online and indicating its most recent update was June 12, 2012, (i) how often is this page updated, (ii) given that some cases thereupon are from 2013, when was this page last updated, (iii) whose responsibility is it to update this page, (iv) what cases are currently being monitored for potential addition to this page; (e) with respect to cases involving bijuralism and harmonization, (i) in what ways are these made known to the Department, (ii) whose responsibility it is to monitor these cases, (iii), what role does the Federal government play in these cases if a party, (iv) what role does the government play if not a party, (v) who m ...

L’article 2 de la loi fédérale sur l’assurance vieillesse et survivants ainsi que l’article 1er de la loi fédérale sur l’assurance invalidité, qui régissent l’assurance facultative dans ces branches d’assurance pour les ressortissants suisses résidant dans un État auquel le présent accord ne s’applique pas, sont applicables aux personnes résidant hors de Suisse qui sont des ressortissants des autres États auxquels le présent accord s’applique ainsi qu’aux réfugiés et apatrides résidant sur le territoire de ces États, lorsque ces personnes déclarent leur adhésion à l’assurance facultative au plus tard une année à compter du jour où elles ont cessé d’être couvertes par l’assurance vieillesse, survivants et invalidité suisse après une période d’assurance ininterrompue d’au moins cinq ans.
Article 2 of the Federal Old-Age and Survivors’ Insurance Act and Article 1 of the Federal Invalidity Insurance Act, which govern voluntary insurance in these insurance branches for Swiss nationals resident in States not subject to this Agreement, shall be applicable to persons resident outside Switzerland who are nationals of the other States to which this Agreement applies, and to refugees and stateless persons resident in the territory of these States, where these persons join the voluntary insurance scheme not later than one year after the date on which they ceased to be covered by old-age, survivors’ and invalidity insurance after a continuous period of insurance of at least five years.

“federal institutions” includes any of the following institutions of the Parliament or Government of Canada: (a) the Senate, (b) the House of Commons, (c) the Library of Parliament, (c.1) the office of the Senate Ethics Officer and the office of the Conflict of Interest and Ethics Commissioner, (d) any federal court, (e) any board, commission or council, or other body or office, established to perform a governmental functions by or pursuant to an Act of Parliament or by or under the authority of the Governor in Council, (f) a department of the Government of Canada, (g) a Crown corporation established by or pursuant to an Act of Parliament, and (h) any other body that is specified by an Act of Parliament to be an agent of Her Majesty in right of Canada or to be subject to the direction of the Governor in Council or a minister of the Crown, but does not include (i) any institution of the Council or government of the Northwest Territories or of the Legislative Assembly or government of Yukon or Nunavut, or (j) any Indian band, band council or other body established to perform a governmental function in relation to an Indian band or other group of aboriginal people [.]

Unfortunately, article 2.10.7 prescribes yet another legislative hierarchy which applies in the event of arbitration, namely: first, there are federal laws of overriding national importance; second, federal laws implementing international agreement obligations; third, other federal legislation; fourth, territorial legislation implementing international Canadian obligations; fifth, Tlicho laws; and finally, other territorial legislation.

(b) where there is no such agreement, no more than the net salvage value of the line or segment, as determined by the Agency (5) If, pursuant to an order under subsection (3), a main line or segment operated by one railway company is transferred to another railway company (a) the railway company that operated the line or segment ceases to have any obligations under this or any other Act of Parliament in respect of the operation of the line or segment; (b) if the railway company to which the line or segment is transferred is within the legislative authority of Parliament, (i) that railway company shall be deemed to have assumed all the obligations under this or any other Act of Parliament in respect of the operation of the line or segment, and (ii) the line or segment shall continue to be a main line for the purposes of this Division, even though it is a subsidiary, secondary, local or feeder line of that railway company; (c) if there is, at the time of the transfer, an agreement between the railway company that operated the line or segment and VIA Rail Canada Inc. in respect of the operation of a rail passenger service on the line or segment, (i) the rights and obligations under the agreement of the railway company that operated the line or segment in respect of the operation of that service vest in the railway company to which the line or segment is transferred and continue, as amended by agreement between VIA Rail Canada Inc. and the company to which the line or segment is transferred, until the operation of the line or segment is abandoned or the operation of the service is discontinued, and (ii) the line or segment is hereby declared to be a work for the general advantage of Canada; (d) where the railway company to which the line or segment is transferred is not within the legislative authority of Parliament and there is not at the time of the transfer an agreement described in paragraph (c) in respect of the line or segment, any declaration that the line or ...

(iii) the person had reasonable grounds to believe that any other occupant of the motor vehicle was a person who could not be convicted of an offence under this Act or any other Act of Parliament; and (b) in the case of a prohibited weapon, a restricted weapon, a prohibited device or any prohibited ammunition, (i) the person or any other occupant of the motor vehicle is the holder of an authorization or a licence under which the person or other occupant may transport the prohibited weapon, restricted weapon, prohibited device or prohibited ammunition, or (ii) the person had reasonable grounds to believe that any other occupant of the motor vehicle was (a) the holder of an authorization or a licence under which the other occupant may transport the prohibited weapon, restricted weapon, prohibited device or prohibited ammunition, or (b) a person who could not be convicted of an offence under this Act or any other Act of Parliament (2) Every person who commits an offence under subsection (1) (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years; or (b) is guilty of an offence punishable on summary conviction (3) Subsection (1) does not apply to an occupant of a motor vehicle who, on becoming aware of the presence of the firearm, prohibited weapon, restricted weapon, prohibited device or prohibited ammunition in the motor vehicle, attempted to leave the motor vehicle, to the extent that it was feasible to do so, or actually left the motor vehicle (4) Subsection (1) does not apply to an occupant of a motor vehicle where the occupant or any other occupant of the motor vehicle is a person who came into possession of the firearm, prohibited weapon, restricted weapon, prohibited device or prohibited ammunition by the operation of law'.
