A declaration by an organiser of a package or a trader facilitating a linked travel arrangement that he is acting exclusively as a travel service provider, as an intermediary or in any other capacity, or that a package or a linked travel arrangement does not constitute a package or a linked travel arrangement, shall not absolve that organiser or trader from the obligations imposed on them under this Directive.

4. Si l’organisateur est dans l’impossibilité de proposer d’autres arrangements appropriés, ou si le voyageur n’accepte pas les autres arrangements proposés parce qu’ils ne sont pas comparables à ce qui était convenu, l’organisateur, pour autant que le forfait inclue le transport de passagers, fournit au voyageur, sans supplément de prix pour celui-ci, un transport équivalent vers le lieu de départ ou tout autre lieu ayant reçu son accord et, si les prestations convenues dans le contrat n'ont pas été fournies, le dédommage conformément à l’article 12.
4. If it is impossible for the organiser to offer suitable alternative arrangements or the traveller does not accept the alternative arrangements proposed because they are not comparable to what was agreed in the contract, the organiser shall, insofar as the package includes the carriage of passengers, provide the traveller at no extra cost with equivalent transport to the place of departure or to another place to which the traveller has agreed and shall, where the services agreed in the contract have not been provided, compensate the traveller in accordance with Article 12.

4.
